Duration for Soliciting Opinions on the Draft National Standards in Vietnam is at Least 60 Days

On July 29, 2013, the Ministry of Culture, Sports, and Tourism of Vietnam issued Circular 05/2013/TT-BVHTTDL regulating the activities of developing national standards and national technical regulations.

According to Article 17 of Circular 05/2013/TT-BVHTTDL, the implementation of drafting national technical standards in Vietnam is regulated as follows:

- The Contract for implementing the project of drafting national technical standards shall be signed in accordance with Clause 1, Article 11 of this Circular.

- The procedure for drafting national technical standards:

+ Agencies and organizations assigned by the Ministry of Culture, Sports, and Tourism to organize the implementation of drafting national technical standards (hereafter referred to as the Drafting Organization) shall draft the national standard in accordance with points a, b, d, dd, e, and g, Clause 2, Article 11 of this Circular;

+ The collection of opinions on the draft national technical standards shall be carried out in accordance with point c, Clause 2, Article 11 of this Circular and the following regulations:

++ The Drafting Organization shall send the draft national technical standard (including both the Draft text and electronic file) along with the explanatory note to the Notification Authority and Inquiry Point of the Ministry of Culture, Sports, and Tourism on Technical Barriers to Trade to determine the necessity of notifying WTO according to Decision 09/2006/QD-BKHCN dated May 4, 2006, of the Minister of Science and Technology regulating the notification and inquiry process of the network of Notification Authority and Inquiry Points of Vietnam on technical barriers to trade. The explanatory content of the draft national technical standard shall follow the form specified in Appendix VIII issued with this Circular.

++ The duration for collecting opinions on the draft national standard is at least 60 (sixty) days from the date of sending the draft. In urgent cases, the duration for collecting opinions may be shorter as decided by the Minister of Culture, Sports, and Tourism.

- The receipt of the draft national technical standard dossier for verification shall be applied according to Clause 3, Article 13 of this Circular.
