Draft Law on Population 2020: Implementation of Gender Imbalance Control

Draft Population Law 2020 of the National Assembly stipulates the responsibility to implement gender imbalance control.

To be specific, in Article 17 of the Draft Population Law 2020, specific responsibilities for gender balance control are outlined as follows:

- State agencies managing population, and other agencies and organizations, according to their assigned functions and tasks, are responsible for implementing measures to control gender imbalance at birth and measures to promote gender equality.- People's Committees at all levels are responsible for organizing and implementing measures to ensure gender balance at birth, and measures to promote gender equality in their respective localities.- Employers are responsible for implementing gender equality measures and enhancing the status of women within their agencies and units.- Medical staff are responsible for adhering to regulations prohibiting gender selection of fetuses, not providing information about the gender of the fetus, except in cases of medical examination, diagnosis, and treatment of gender-related diseases.- Family members should create a comfortable mental space for couples and individuals when having children; not threaten or mentally coerce couples or individuals to have sons or daughters, or incite and force others to abort fetuses because of their gender; not speak or act in ways that insult the honor and dignity of those who bear only sons or only daughters.- Couples and individuals are responsible for complying with the law on gender equality; not engaging in any form of gender selection of fetuses.- The community and family lines are encouraged to develop conventions and agreements on practicing gender equality, eliminating the preference for males over females or females over males.

Hence, agencies responsible for population management, People's Committees, medical staff, and citizens are responsible for complying with regulations ensuring gender balance. Couples must practice gender equality and are prohibited from selecting the gender of the fetus.
