Dossier for Monthly Survivors' Benefits Settlement Upon the Death of Individuals with Meritorious Services

This content is detailed in Circular No. 05/2013/TT-BLDTBXH guiding the procedures for dossier creation, dossier management, and implementation of preferential policies for people with meritorious services to the revolution and their relatives.

According to the provisions of Circular 05/2013/TT-BLDTBXH, the dossier for monthly death benefit processing when a person with meritorious services to the revolution passes away includes the following documents:

- Declaration of the relative of the deceased person with meritorious services to the revolution (Form TT1);- Copy of the Death Certificate;- Dossier of the person with meritorious services to the revolution;- Decision on the Allowance (Form TT2).

The procedure for processing monthly death benefits when a person with meritorious services passes away is as follows:

- The relative of the person with meritorious services is responsible for making a declaration on the situation of the relative and sending it to the Commune People's Committee along with a copy of the death certificate.

- In case the relative is a child under 18 years old, a copy of the Birth Certificate must be included.- In case the relative is a child aged 18 years or older who is studying, a certificate from the educational institution where they are studying must be included; if studying at a vocational education or higher education institution, a copy of the High School Graduation Diploma or a certificate from the high school about the time of completion must be included.- In case the relative is a child aged 18 years or older with severe or particularly severe disabilities from a young age, a certificate of the disability level from the Disability Level Determination Council must be included.- In case the relative is a child aged 18 years or older with severe or particularly severe disabilities after reaching 18 years without a monthly income or with a monthly income lower than 0.6 times the standard level, a certificate of the disability level from the Disability Level Determination Council and an income certificate (Form TN) from the Commune People's Committee must be included;

- The Commune People's Committee, within 05 days from the date of receiving the declaration and accompanying documents, is responsible for certifying the relative's situation (including the case where the relative receives an additional monthly foster care allowance) and sending the stipulated documents mentioned above to the Department of Labor - Invalids and Social Affairs;- The Department of Labor - Invalids and Social Affairs, within 10 days from the date of receiving all the documents, is responsible for making a list of those eligible for the monthly death benefit and sending it to the Department of Labor - Invalids and Social Affairs along with the valid documents;- The Department of Labor - Invalids and Social Affairs, within 10 days from the date of receiving all the documents, is responsible for verifying, matching the dossier of the person with meritorious services being managed, and issuing a decision on the allowance. In case a war invalid dies due to wound relapse and is confirmed as a martyr, the Department of Labor - Invalids and Social Affairs will issue a certificate of the martyr's family and the death benefit, and pay the difference to the eligible relatives.
