Documents and materials serving as the basis for re-registration of birth applicable from July 16, 2020

This is a notable regulation in Circular 04/2020/TT-BTP detailing the implementation of certain articles of the Civil Status Law and Decree 123/2015/ND-CP providing detailed regulations and implementation measures for the Civil Status Law.

  1. A copy of the Birth Certificate legally issued by the competent Vietnamese authority.

  2. The original or a copy of documents that can replace the Birth Certificate issued before 1945 in the North and before 1975 in the South.

In case the requester for re-registration of birth does not have the aforementioned documents, the following documents legally issued by Vietnamese authorities can be used as the basis to determine the content of re-registration of birth:

- Identity card, Citizen identification card, or Passport;

- Household registration book, Temporary residence book, documents proving the place of residence;

- Graduation certificate, Certificate, Diploma, School records issued or certified by the competent authority;

- Other documents containing information about the individual's surname, name, date, month, and year of birth.

The requester for re-registering birth is responsible for submitting complete copies of the mentioned documents (if available) and making a declaration about having submitted all the documents in their possession; and bearing the responsibility and consequences of not making a truthful declaration as prescribed in Article 5 of Circular 04/2020/TT-BTP.

For cases where the documents of the requester for re-registering birth do not have information proving the parent-child relationship, the civil registration authority will send a written request to the competent public security authority for verification.

When the public security authority responds that there is no information, the civil registration authority will ask the requester to prepare a declaration on the information of the parents as prescribed in Article 4, Article 5 of Circular 04/2020/TT-BTP and determine the birth registration content based on the declaration.
