Disclosure in the Operations of State Agencies

Decree 04/2015/ND-CP stipulates democracy in the activities of state administrative agencies and public service providers, including democracy within the internal units of the agency; in relations and handling of work with citizens, related agencies, and organizations.

The public disclosure of activities within administrative bodies and public service providers for officials and public employees to be aware of is one of the clearest manifestations of democracy within these organizations and units. Public disclosure contributes to the prevention, deterrence, and fight against corrupt practices, wastefulness, bureaucracy, and harassment of the public.

Decree 04/2015/ND-CP stipulates that the following tasks and contents must be disclosed for the knowledge of officials and public employees:

- Policies and guidelines of the Communist Party and the laws of the State related to the work of the organization or unit;- Annual, quarterly, and monthly work plans of the organization or unit;- Annual operating budget, including funds provided by the state budget and other financial sources; annual budget settlement of the organization or unit; assets and equipment of the organization or unit; audit results;- Recruitment, training, development, transfer, appointment, rotation, secondment, resignation, dismissal; employment contracts, changes in professional titles, changes in job positions, termination of employment contracts of public employees; overseas business trips, resolution of policies, salary grade increase, rank promotion, evaluation and classification of officials and public employees; rewards, discipline, resignation, and retirement of officials and public employees; projects and legal normative documents of the organization or unit;- Negative incidents and corruption cases within the organization or unit that have been concluded; asset and income declarations of individuals obligated to declare as required by law;- Results of inspections, examinations, and resolution of complaints and denunciations within the organization or unit;- Internal rules and regulations of the organization or unit;- Results of feedback from officials and public employees on issues under the decision-making authority of the head of the organization or unit put forth for consultation with officials and public employees;- Directives and operational documents from upper-level management bodies related to the work of the organization or unit.

Based on the characteristics, nature of activities, and content to be disclosed, organizations and units can apply one or more of the following forms of disclosure:

- Posting at the organization's or unit’s premises;- Announcing at meetings of officials and public employees of the organization or unit;- Written notifications sent to all officials and public employees;- Notification to the heads of departments within the organization or unit, requiring them to inform the officials and public employees working in those departments;- Written notification to the direct supervisory committee and the Executive Committee of the Trade Union of the organization or unit;- Posting on the internal information portal of the organization or unit.

The disclosure timeline shall not exceed three working days, or in special cases, no more than five days from the date the document is issued or from the date the document is received from the upper-level management body. Documents disclosed by posting at the headquarters of the organization or unit must be posted for at least 30 consecutive days from the date of posting.
