Regarding this issue, LawNet would like to answer as follows:
October 27, 2023, the Politburo issued Regulation 131-QD/TW on controlling power and preventing corruption and misconduct in inspection, supervision, enforcement of party discipline, and inspection and auditing activities.
Specifically, Regulation 131-QD/TW clearly states 22 corrupt and misconduct acts in inspection, supervision, enforcement of party discipline, and inspection and auditing activities as follows:
1. Bribery, accepting bribes, brokering bribes, or bribing people with responsibilities, positions, powers, or related people to reduce or avoid responsibility for the violator.
2. Providing and disclosing information, documents, and records of inspection subjects to organizations and individuals without authority or responsibility especially information, documents, and records that are in the process of inspection, supervision, enforcement of party discipline, or inspection or audit.
3. Receiving money, property, or other material or non-material benefits and participating in fun and entertainment activities from the test subject or people related to the test subject.
4. Taking advantage of familiar relationships or using one's or others' advantages, position, or reputation to influence, take advantage of, and put pressure on inspection subjects, related organizations, and individuals for profit or other personal motives.
5. Taking advantage of internal information or unfavorable information of organizations and individuals to set conditions and exert pressure on inspection subjects, persons with authority and responsibility in performing the tasks of inspection, supervision, enforcement of party discipline, inspection, and auditing for profiteering or other personal motives.
6. Let people with family relationships take advantage of their positions and powers to manipulate and interfere with inspection, supervision, enforcement of party discipline, inspection, and audit.
7. Introducing personal intentions and setting criteria, conditions, comments, and assessments that are imposing, not true in nature, or untrue to benefit or disadvantage the test subject.
8. Confirmation, comments, assessments, conclusions, and recommendations that are untrue or falsify the content of the file, the nature of the case, or the violation of the inspection subject.
9. Agreeing and setting conditions with the inspection subject or people related to the subject; improperly or incompletely implementing regulations to change or falsify results and conclusions of inspection, supervision, inspection, and audit.
10. Not recommending referral to competent authorities for handling according to the provisions of law when detecting a case with signs of crime; Do not recommend or direct, handle material recovery, or discipline according to authority for violations when conducting inspection, supervision, inspection, or audit.
11. Directing or providing information and documents that are untrue, have not been authorized to be published, or fail to properly implement conclusions and recommendations on inspection, supervision, enforcement of party discipline, inspection, and audit.
12. Meeting, contacting, and communicating improperly with inspection subjects; using verification and verification documents for improper purposes.
13. Covering up, abetting, delaying or not concluding, not handling or concluding, handling the content, nature, and extent of violations incorrectly, or not reporting to competent authorities for handling according to regulations

14. Carrying out tasks of inspection, supervision, enforcement of party discipline, inspection, and audit beyond authority; not in accordance with the professional process, scope, subject, content, and time as prescribed. Obstructing or illegally intervening in inspection, supervision, enforcement of party discipline, inspection, and audit.
15. Revealing state secrets, professional secrets, harassing, causing difficulties, having an imposing attitude, being disrespectful, not following industry regulations, and illegally intervening in the activities of inspection subjects.
16. Failure to handle or not report to competent authorities for handling according to regulations when receiving information, applications, letters of feedback, or denunciations of inspected subjects.
17. Taking advantage of position, power, or the prestige and influence of yourself and your family to suggest, influence, and put pressure on those with decision-making authority or to advise on inspection, supervision, party disciplinary enforcement, inspection, and audit conclusions that are not true to the nature of the incident.
18. Influencing competent people to help inspection subjects obtain unjustified results and benefits that affect the interests of the state, agencies, organizations, or individuals.
19. Directly or indirectly supporting inspection subjects in performing acts to avoid or reduce responsibility.
20. Failure to promptly change members of the inspection, supervision, party discipline, inspection, and audit team when there are grounds to determine that members are not impartial and objective in their work; Failure to promptly direct and resolve the difficulties and problems of the delegation.
21. Failure to promptly check, supervise, inspect, and audit organizations, agencies, units, and individuals with signs of violation, complaints, letters, and denunciations that have been determined to be well-founded
22. Other corrupt and misconduct acts according to the Party's regulations and the law.
