Delegation of Management for Militia and Self-Defense Units in 2020

This is a notable content stipulated in Decree 72/2020/ND-CP detailing certain provisions of the Militia and Self-defense Force Law concerning the organization, development of forces, and policies regarding the Militia and Self-defense Force.

Specifically, in Article 3 of Decree 72/2020/ND-CP, which regulates the decentralization of militia units as follows:

First, managed by the Hanoi Capital Command, Ho Chi Minh City Command, and Provincial Military Command Headquarters:

- The military command headquarters of agencies and organizations belonging to enterprises with self-defense battalions; the military command headquarters of agencies and organizations under departments, boards, and equivalent authorities at the provincial level, management boards of industrial zones, export processing zones, high-tech zones, and economic zones;

- Permanent militia flotillas;

- Self-defense militia anti-aircraft artillery, self-defense artillery companies; self-defense battalions, self-defense naval flotillas during training and activities.

Second, managed by the district-level military command headquarters:

- The military command headquarters of agencies and organizations not specified in Item a, Clause 1 of this Article;

- Self-defense militia anti-aircraft artillery, self-defense artillery companies; self-defense battalions, self-defense naval flotillas except during training and activities;

- The district-level permanent militia units; self-defense militia units organized by the district during training and activities.

Third, managed by the commune-level military command headquarters, military command headquarters of agencies, organizations, and self-defense unit commanders where there is no military command headquarters for agencies and organizations:

- Self-defense militia units organized by their level;

- Self-defense militia units organized by higher-level authorities except during training and activities.

Fourth, managed by the Naval Forces Command:

- Self-defense units in state enterprises with sea-going vessels;

- Self-defense units in enterprises under the Naval Forces Command.

Fifth, managed by the head of military enterprises managing self-defense units under their authority.
