Delayed Conversion of ID Cards to Citizen Identification Cards: Is There a Penalty?

Mr. Truong Minh Nhan (Email: minhanh***@yahoo.com) inquired: “My identity card was issued by the Ho Chi Minh City Police Department on February 08, 2000. Do I need to convert my identity card to a Citizen Identification Card? Will there be any penalty for a delayed conversion?”

Regarding this matter, Legal Secretary would like to explain to Mr. Truong Minh Nhan as follows:

1. Based on Article 2 of Decree 05/1999/ND-CP, the Identity Card is valid for 15 years from the date of issuance. Therefore, your Identity Card has expired.

2. According to the Citizen Identity Law of 2014, in this case, you must switch to a Citizen Identity Card.

3. In the case where the Identity Card has expired and you do not switch to the Citizen Identity Card, you will be warned or fined between 100,000 - 200,000 VND (Based on Point b Clause 1 Article 9 of Decree 167/2013/ND-CP).

Article 9. Violations regarding the management and use of Identity Cards


1. A warning or a fine from 100,000 VND to 200,000 VND shall be issued for any of the following acts:



b) Failure to comply with the regulations on requesting the issuance of a new or replacement Identity Card;
