Recently, the Government of Vietnam has issued Decree 88/2020/ND-CP guiding the Law on Occupational Safety and Health regarding compulsory insurance for occupational accidents and diseases.
Decree 88: 03 Conditions for Occupational Disease Treatment Cost Support for Employees (Illustrative image)
Article 20 Decree 88/2020/ND-CP stipulates that employees will be supported with treatment costs for occupational diseases if they meet the following 03 conditions:
In addition, this Decree stipulates the level of support for occupational disease treatment costs and the procedure for resolving support for treatment costs as follows:
- The support level is 50% of the treatment cost for occupational diseases, calculated according to the price list of occupational disease treatment at the time the employee receives treatment, as prescribed by the Minister of Health, after being covered by health insurance, but not exceeding 15 million VND/person.- The maximum number of support times for each employee is 02 times, and in one year only 01 support can be received.
1. Written request for support for occupational disease treatment costs for the employee.
2. Certified copy of the dossier determining the occupational disease from the occupational disease medical examination and treatment facility.
3. Copy of the discharge paper or extract of the medical record after the occupational disease treatment.
4. Copy of receipts for payment of occupational disease treatment costs.
- The employer submits 01 dossier as prescribed to the Department of Labor, War Invalids and Social Affairs and brings along the original payment receipts for comparison with the copies.- Within 05 working days from the date of receiving the complete and valid dossier as prescribed, the Department of Labor, War Invalids and Social Affairs will appraise the dossier, decide on the support, and send the decision (along with the data list of support) to the social insurance agency. If support is not provided, a written response must be given to the employer or the employee who submitted the request, clearly stating the reason.- Within 05 working days from the date of receiving the support decision from the Department of Labor, War Invalids and Social Affairs, the social insurance agency is responsible for disbursing the support funds for occupational disease treatment to the employee. If payment is not made, a written response must be given to the Department of Labor, War Invalids and Social Affairs, clearly stating the reason.
