Declaration and Update of Aviation Infrastructure Asset Database

Regarding principles, all aviation infrastructure assets are assigned by the State to management entities as per regulations. The management must ensure uniformity, clearly delineate authority and responsibility of each agency and unit, and establish cooperation responsibilities between state agencies. Importantly, there should be a clear distinction between the state management functions of state agencies and the business operations of enterprises.

Per Decree 44, aviation infrastructure assets must be reported, declared, and updated in the database. To be specific:

Aviation Infrastructure Asset Reporting

Asset declaration reports are conducted in the following forms:

- Initial declaration report for assets being managed at the time Decree 44 comes into effect;- Supplemental declaration report for newly arisen assets or changes in asset information, agency information, or asset management units after Decree 44 comes into effect.

The agency assigned to manage the assets shall prepare asset declaration reports according to the prescribed Form, submit them to the Ministry of Transport for approval, and then input the data into the aviation infrastructure asset database.

The deadline for submitting declaration reports is 30 days from the date of receiving the assets as per the asset management assignment decision of the competent authority or upon changes in management agency or declared assets' information.

Annually, the agency assigned to manage assets shall report on the management, use, and exploitation of aviation infrastructure assets of the previous year and submit extraordinary reports upon the request of competent state agencies.

Forms of management, use, and exploitation reports include:

- Management situation report- Asset handling situation report- Asset exploitation situation report

Regarding Reporting Deadlines

The deadlines for submitting annual management, use, and exploitation reports of aviation infrastructure assets are prescribed as follows:

- The agency assigned to manage assets shall submit reports to the Ministry of Transport before February 28;- The Ministry of Transport shall compile the management and use of aviation infrastructure assets and submit them to the Ministry of Finance before March 15;- The Ministry of Finance shall compile the nationwide management and use of aviation infrastructure assets to report to the Government of Vietnam and the National Assembly as required, and make public the national assets.

Aviation Infrastructure Asset Database

The aviation infrastructure asset database is a part of the national public asset database, constructed and uniformly managed nationwide; information in the aviation infrastructure asset database holds legal value equivalent to paper documents.

To construct and manage the database, the Ministry of Transport shall lead and cooperate with the Ministry of Finance and relevant agencies to meet the following requirements:

- Conform to the architecture framework of the Government of Vietnam's electronic system, meeting national database technical standards, IT technical standards, security, information safety, and economic-technical standards;- Ensure compatibility, integration capability with the national public asset database, information sharing, and expandability of data fields in the system design and application software.

The Ministry of Transport shall direct the agency assigned to manage assets to report declarations and input data into the aviation infrastructure asset database system as prescribed.

Decree 44/2018/ND-CP takes effect from March 13, 2018.
