Decision on acceptance, investigation, and conclusion of complaint content in Vietnam

On March 02, 2015, the Ministry of Public Security of Vietnam issued Circular 12/2015/TT-BCA stipulating the procedures for resolving denunciations within the People’s Public Security force.

Circular 12/2015/TT-BCA stipulates that the person resolving the complaint must issue a decision to accept and settle the complaint (hereinafter referred to as the acceptance decision). Any amendments or supplements to the acceptance decision must be made by the decision of the person resolving the complaint. Specific details are as follows:

- In cases where the person resolving the complaint directly conducts verification, the acceptance decision must establish a Complaint Verification Team or a Complaint Verification Group (hereinafter collectively referred to as the Verification Group) consisting of two or more persons, with one appointed as the Head of the Verification Group (hereinafter referred to as the Head of the Verification Group). The acceptance decision and the establishment of the Verification Group must clearly state the names of the agencies, organizations, and units being complained against; the full names, titles, positions, and addresses of the individuals being complained against; the full names, titles, and positions of each person in the Verification Group; the content to be verified; the verification time limit; the authority and responsibilities of the Verification Group. The acceptance decision and the establishment of the Verification Group are to follow the prescribed form.

- In cases where the person resolving the complaint assigns the task to the inspection agency of the same level or other functional agencies to conduct the verification of the complaint content, the acceptance decision must clearly state the agency, organization, and unit assigned to verify; the agency, organization, and unit being complained against; the full name and address of the person being complained against; the content to be verified; the verification time limit. The head of the inspection agency or other functional agency assigned to verify the complaint content is responsible for establishing the Verification Group.

Note: The person resolving the complaint must notify the complainant in writing about the acceptance of the complaint and the complaint contents accepted in the prescribed form.
