The Ministry of Construction issued Circular 09/2016/TT-BXD on March 10, 2016, to specifically list the necessary work contents of a construction contract.
Circular 09 stipulates that the contents and scope of work in a construction contract constitute the contents and scope of work agreed upon by the contracting parties in accordance with the scope of work of the contract and must be clearly agreed upon by both parties in the contract. The scope of work is determined based on the bidding documents or request documents, bidding dossiers or proposal dossiers, negotiation records, and related legal documents.
The contents of the construction contract may include all or some of the following tasks:
- Handover and acceptance, management of the construction site, acceptance, and preservation of construction benchmarks and base lines.- Provision of construction materials, manpower, machinery, and construction equipment for the construction of the project as per the contract.- Construction of the project in accordance with the approved design documents and current construction standards and regulations.- Execution of surveying and monitoring of the project as per design requirements. Conducting tests, inspections, single and integrated trial runs as per the plan before requesting acceptance.- Quality control of construction work and equipment installation; supervision of construction activities carried out by subcontractors in case of a principal contractor or general contractor role.- Handling and rectifying any errors or defects in quality during the construction process (if any).- Testing and inspecting the quality of construction materials and construction components.- Conducting work acceptance for construction phase transitions, construction phase acceptance, or sectional work acceptance; work completion acceptance of construction items or the entire construction project.- Implementing safety assurance, environmental protection, and fire and explosion prevention measures.- Securing the construction site and the construction area within the scope of the construction contract.- Ensuring the security and order of the construction area.- Collaborating with other contractors on site (if any).- Clearing the construction site and handing over the completed construction product.- Other tasks during the contract execution as agreed in the contract, attached documents, and legal regulations.
