The Ministry of Transport issued Circular 38/2016/TT-BGTVT on December 2, 2016, stipulating specific information that must be reported in the event of a railway traffic accident.
Accordingly, Circular 38 stipulates that initial information about the accident must be promptly and accurately reported and includes the following main contents:
- The location of the accident (km, area, commune, ward, district, province, city);- The time of the accident;- The number of dead and injured persons;- A preliminary state of the scene, vehicles involved in the accident, and affected infrastructure;- Other information as requested by the recipient of the report.
Additionally, Circular 38 mandates that apart from the initial reporting as outlined above, the train conductor or engineer (if the accident occurs outside a station); or the station master or on-duty train operator (if the accident occurs within a station) must prepare an accident report and submit it along with the Initial Accident File to the relevant authorities.
Note, the Vietnam Railway Authority, and businesses operating the national railway infrastructure must organize a permanent department, establish a 24/24 hour telephone number to receive and promptly report information regarding railway traffic incidents and accidents, and publicly disclose the telephone number, fax number, and email address on mass media.
