Conditions for Promotion in Rank and Salary Increase for Retired Officers

Recently, the Minister of Public Security signed and issued Circular 17/2013/TT-BCA, providing guidelines for rank promotion, salary increase for police officers and employees upon retirement.

According to the legal regulations, the consideration for promotion and salary increase for officers and police employees upon retirement is conducted once before the pre-retirement waiting period or before receiving a pension. Furthermore, the state will not base the officer's rank promotion before retirement to re-determine the age limit for service.

Promotion standards for officer ranks upon retirement, Circular 17/2013/TT-BCA

To be specific, officers and police employees upon retirement are considered for promotion and salary increase if the rank and salary they currently hold are lower or equal to the highest rank and salary regulated for the positions they hold and meet the set standards and time requirements, specifically stipulated in Article 4 of Circular 17/2013/TT-BCA as follows:

- First: Officers and police employees awaiting retirement who have held their rank and salary for 2/3 of the term or more and during this time have not been disciplined from a reprimand or higher (in terms of party, government, or unions) will be considered for rank promotion or salary increase immediately preceding the pre-retirement period by 3 months. If they qualify for 2/3 of the term at the time of receiving the pension, they will be considered for rank promotion or salary increase immediately preceding the pension period by 3 months. Officers who have received a rank-based salary promotion for the second time will be considered for rank promotion immediately preceding the pre-retirement period by 6 months (except for subjects regulated in Clause 1, Clause 2, Article 5, and Clause 2, Article 7 of this Circular);- Second: During the period of holding the rank or salary before retirement, if officers or police employees are disciplined from a reprimand or higher (in terms of party, government, or unions), they must meet the entire term requirement to be considered for rank promotion or salary increase immediately preceding the pre-retirement period by 3 months (if qualified at the pre-retirement time) or immediately preceding the pension period by 3 months (if qualified at the pension time);- Third: Officers who are not party members upon retirement, if they meet the standards, conditions, and term outlined above, will be considered for the next salary level. If the current rank is lower than the rank of Captain, they will simultaneously be considered for the next rank promotion;

It should be noted that the "term" for promotion and salary increase under this Circular is determined as the period for consideration of promotion and salary increase as stipulated in Clause 1, Section II of Circular 10/2007/TT-BCA dated August 2, 2007; Circular 03/2005/TT-BNV dated January 5, 2005; and is calculated from the time the officer and police employee were promoted or received their current salaries to the pre-retirement waiting period or pension period. Years during which officers and police employees did not complete tasks or did not participate in performance evaluation due to extended leave from duty are not counted.
