On November 9, 2015, the Ministry of National Defense issued Circular 124/2015/TT-BQP providing guidelines for implementing policies on compensation, allowances, and medical expenses for individuals working in the military who suffer from occupational accidents and diseases.
To be eligible for compensation for occupational accidents and diseases, employees working in the Army must meet the following conditions:
- The employee suffers from an occupational accident that results in a reduction of the working capacity by 5% or more, or death, except in cases where occupational accident compensation is received;- The employee suffers from an occupational disease as concluded by the Medical Assessment Council or an authorized forensic agency, and compensation is provided in the following cases:- Death due to occupational disease while working or before transitioning to another job, before quitting, before losing the job, or before retiring;- A reduction of the working capacity by 5% or more due to an occupational disease as per the results of regular occupational disease assessment examinations (as prescribed by the Ministry of Health).
Circular 124/2015/TT-BQP is effective from December 25, 2015, replacing Circular 14/2004/TT-BQP.
