The conditions for Claiming support for Forces Participating in Security and Order Protection at the Grassroots Level in Case of Injury, Accident, or Death in Vietnam are stipulated in Decree 40/2024/ND-CP.

Conditions for Claiming support for Forces Participating in Security and Order Protection at the Grassroots Level in Case of Injury, Accident, or Death in Vietnam

According to Clause 2, Article 24 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023:

- Persons who are not covered by health insurance but suffer illness, accidents, or injuries shall be provided with payment support for medical examination and treatment costs.

- Persons who are not covered by social insurance but experience accidents leading to a decrease in working capacity as concluded by the Medical Examination Council shall be considered for allowances depending on the degree of their reduced working capacity; if they die, their relatives shall receive death benefits and funeral expenses.

The conditions for members of the forces participating in security and order protection at the grassroots level to be entitled to the above policies are detailed in Article 5 and Article 6 of Decree 40/2024/ND-CP as follows:

(1) In cases where members are not covered by health insurance but suffer illness, accidents, or injuries while performing duties:

- Members participating in the security and order protection forces at the grassroots level while performing duties as assigned per plans of competent authorities or when mobilized, organized, or directed to perform duties, if they suffer illness, accidents, or injuries, shall be provided with payment support for medical examination and treatment costs at medical facilities as regulated.(*)

- Members of the security and order protection forces at the grassroots level shall not be entitled to medical examination and treatment costs if they suffer illness, accidents, or injuries in any of the following cases:

+ Not covered under case (*);

+ Intentional self-harm;

+ Accidents arising from personal disputes unrelated to duty performance;

+ Accidents due to the use of alcohol, beer, drugs, psychoactive substances, precursors, or other addictive substances as regulated by law.

(2) In cases where members are not covered by social insurance but suffer accidents or die while performing duties:

- While performing duties as assigned per plans of competent authorities or when mobilized, organized, or directed to perform duties;

- In the time frame and route from residence to the duty performance location.

- Cases not entitled to medical examination and treatment costs if they suffer illness, accidents, or injuries as stated in item (1) and accidents or deaths not entitled to support policies.

Support Levels for Forces Participating in Security and Order Protection at the Grassroots Level in Case of Injury, Accident, or Death in Vietnam

Members of the security and order protection forces at the grassroots level shall be provided support for medical examination and treatment costs and daily meal allowances during inpatient treatment until health stabilization and discharge, as stipulated by the Provincial People's Council.

In case of accidents: During the accident treatment period, members are entitled to medical examination, treatment costs, and daily meal allowances, including instances of recurrent injuries, until health stabilization and discharge, as stipulated by the Provincial People's Council.

In case accidents result in death: Relatives shall be entitled to death benefits and funeral expenses, as determined by the Provincial People's Council.
