Citizens are Compensated for Constructing Projects under Program 135

Circular 01/2017/TT-UBDT stipulates the creation of public jobs in the construction, maintenance, and repair of infrastructure works under Project 2: Program 135 (hereinafter referred to as the Program) under the National Target Program for Sustainable Poverty Reduction for the period 2016-2020, approved in Decision 1722/QD-TTg, implemented following the regulations in Decree 61/2015/ND-CP dated July 9, 2015, of the Government of Vietnam, concerning policies for job creation support and the National Fund for Employment.

For projects applying special mechanisms:

- People are paid wages according to the labor agreement with the representative construction unit when participating in labor exceeding the agreed-upon contribution in the village and recorded in the approved construction project file;- The construction unit directly pays wages to local workers when mobilizing local labor for tasks under its responsibility. The wage rate for workers must not be lower than the wage (after taxes) determined in the approved construction project file.

For projects not applying special mechanisms:

- The project budget must clearly specify the costs dedicated to employing local labor, approved by the competent authority;- The contractor must sign a commitment with the Commune People's Committee (UBND) regarding the employment of local labor for appropriate work items, accompanied by a commitment on wage rates and working conditions per legal regulations;- The Commune People's Committee must publicly announce the projects, work items, and wage rates to encourage residents to register and participate according to the public job creation mechanism;- The Commune People's Committee supervises the implementation of the public job creation mechanism in local projects, promptly handles any violations, and reports any breaches by contractors to the District People's Committee (UBND).
