Circular 64: Conducting scene examination in case of waterway traffic accidents in Vietnam

Recently, the Ministry of Public Security promulgated Circular 64/2020/TT-BCA stipulating the procedures for investigating and resolving inland waterway traffic accidents by the Traffic Police Force in Vietnam.

According to the provisions of Article 9 Circular 64/2020/TT-BCA, when conducting on-site examinations, an On-site Examination Record of Waterway Traffic Accidents must be prepared according to form 05/TNDT issued under this Circular and draw a Diagram of the Waterway Traffic Accident Scene according to form 06/TNDT issued under this Circular; the Diagram must be consistent with the On-site Examination Record. The specific process of on-site examination in Vietnam is as follows:

- Observe the entire area where the traffic accident occurred to identify the location of victims, traces, evidence, and vehicles at the scene of the traffic accident;

- Based on the examination direction and reference points at the scene to mark the natural sequential positions of all victims, traces, evidence, vehicles, and traces related to the traffic accident;

- Photograph the scene including: General scene photos, sectional scene photos, film recordings (if any); photograph victims, evidence, vehicles, and related traces and place a measuring scale. The scene photos must be compiled into a Scene Photo Record, arranged in order, with captions;

- Measure and draw a diagram of the traffic accident scene: Use consistent symbols and measurement units; fully represent traffic organization, inland waterway signaling system (onshore, water surface, river crossing projects) where the traffic accident occurred; the annotation section must show the drawing scale, traces, and symbols on the scene diagram. When measuring and drawing the scene, it is necessary to represent the morphology of the river, canal, stream, pond, lake, bay (straight, curved, winding, junction...), geographic direction, flow direction, flow rate, tide, wind direction, depth at the location where the traffic accident occurred; the width of the ship's running lane where the traffic accident occurred;

- Collect and preserve traces and evidence according to legal regulations.
