Circular 50: Dossier for Reissuance of Inland Waterway Port Operation License

On October 17, 2014, the Ministry of Transport issued Circular 50/2014/TT-BGTVT on the management of inland waterway ports and berths.

Circular 50/2014/TT-BGTVT stipulates that the inland waterway port must have the operating permit re-issued in the cases where the Operating Permit expires; Change of ownership; Change of land, water area, or port use.

The owner of the inland waterway port shall submit 01 (one) dossier requesting the re-issuance of the inland waterway port operating permit directly or via the postal system or other appropriate means to the Department of Transport. The dossier includes:

- An application form for re-issuance of the inland waterway port operating permit according to Form No. 11 in the Appendix issued with this Circular;- For the case of re-issuance of the permit due to a change of ownership without changing the contents of the issued permit, the port owner must attach the legal transfer document of the port and relevant dossiers concerning the handover of ownership in case of a change of the port owner or legal documents on division or merger (if any);- In cases of change of land, water area, or use of the port, the port owner must attach the application form with legal documents proving the aforementioned changes;- For the inland waterway port that is newly constructed or upgraded to enhance its capacity, the dossier requesting re-issuance of the operating permit shall be in accordance with the provisions of Article 11 of this Circular;- For such inland waterway ports which were granted operating permits before January 1, 2005, but have lost the dossier, the port owner must attach the application form with the port works site plan, map of the water area, and land area of the port.
