Circular 14: Developing a Plan for Monitoring the Implementation of the Law

On May 15, 2014, the Ministry of Justice issued Circular 14/2014/TT-BTP guiding Decree 59/2012/ND-CP on monitoring the implementation of the law.

Circular 14/2014/TT-BTP prescribes the development of a plan to monitor the enforcement of laws as follows:

- Based on the resolution of the National Assembly at the year-end session on the socio-economic development plan for the following year, the results of the National Assembly's supervision activities, the content of responses to the National Assembly deputies' inquiries, voters' recommendations for that year, and actual law enforcement, before November 30 every year, the Ministry of Justice shall preside over and cooperate with Ministries, Ministry-level agencies, and agencies under the Government of Vietnam to propose to the Government of Vietnam key areas to monitor law enforcement in the Government of Vietnam's resolution on essential tasks and solutions to direct and implement the socio-economic development plan and the State budget estimation for the next year.- Based on the Government of Vietnam's resolution on essential tasks and solutions for directing and implementing the socio-economic development plan and the annual State budget estimation and actual law enforcement within their management scope, within 15 days from the issuance date of the Government of Vietnam's resolution, Ministries, Ministry-level agencies, agencies under the Government of Vietnam, and provincial People's Committees must issue plans to monitor law enforcement of their respective Ministries, sectors, and localities, in which they identify key areas for law enforcement monitoring, ensuring consistency with the key areas in administrative procedure control and legal normative document inspection within the scope of their management for that year.- Based on the key areas to monitor law enforcement in the Government of Vietnam's resolution, the Ministry of Justice shall preside over and cooperate with Ministries and Ministry-level agencies to issue and organize the implementation of plans to monitor law enforcement in key areas and report to the Prime Minister of the Government of Vietnam as prescribed.- The law enforcement monitoring plan includes the following main contents: Purpose and requirements; specific legal normative documents or key legal areas to monitor and evaluate; specific activities and implementation progress; responsibilities of agencies and organizations in implementing the plan; funding for plan implementation.- Ministries, Ministry-level agencies, agencies under the Government of Vietnam, and provincial People's Committees shall send their law enforcement monitoring plans to the Ministry of Justice for monitoring and synthesis.
