Birth registration: names must not be too long, difficult to use (illustration)

To be specific: Circular 04/2020/TT-BTP stipulates that the content of birth registration is determined according to the provisions at Clause 1 Article 14 of the Law on Civil Status, Clause 1 Article 4 Decree 123/2015/ND-CP, and the following guidelines:

- The determination of the surname, ethnicity, and naming of children must comply with the law and the requirements to preserve the national identity, customs, and fine cultural traditions of Vietnam; names must not be too long or difficult to use.

- In the case where parents cannot come to an agreement on the surname, ethnicity, or place of origin of the child when registering the birth, the surname, ethnicity, and place of origin of the child shall be determined according to customs but must ensure the surname, ethnicity, and place of origin of either the father or the mother.

In addition, this Circular also guides several contents on birth registration, for instance, the birth registration for individuals who already have personal records and documents is performed as follows:

- The People's Committee at the commune level where the current residence is located shall carry out the birth registration for Vietnamese citizens residing in the country, born before January 1, 2016, who have not yet registered their birth but already have personal records and documents (originals or valid copies) such as personal identification documents as prescribed in Clause 1 Article 2 of Decree 123/2015/ND-CP; household registration books; temporary residence books; other documents issued by competent Vietnamese authorities.

- The People's Committee at the district level where the previous residence before emigration is located shall carry out the birth registration for Vietnamese people residing abroad, who have not yet registered their birth if they have personal records and documents as prescribed in Clause 1 of this Article, which state the place of birth in Vietnam.

Regarding the birth registration dossier for the aforementioned cases, it includes: Birth registration declaration form, written declaration of non-registration of birth; documents as prescribed at Points b and c Clause 1 Article 26 of Decree 123/2015/ND-CP.

The order of resolution and contents of birth registration shall comply with the provisions at Clause 2, Clause 3, Clause 5 Article 26 of Decree 123/2015/ND-CP and the provisions at Clause 3, Clause 4 Article 9 and Article 10 of Circular 04/2020/TT-BTP.
