The amended Law on Officers of the Vietnam People's Army 2008 was promulgated on June 3, 2008. Notably, this document includes amendments and supplements related to the benefits for officers who cease active service and officers who die or are killed in action, as stipulated in the Law on Officers of the Vietnam People's Army 1999.
To be specific, according to the provisions of Clause 12 of the amended 2008 Law on Officers of the Vietnam People's Army, which supplements and amends Article 37 of the 1999 Law on Officers of the Vietnam People's Army, the benefits for officers ceasing active service and officers who are killed in action or pass away while in service are as follows:
- Retired officers are entitled to the following benefits:
- Pension;- If retiring before the highest age limit for military rank due to organizational changes, restructuring, or the age limit expiration for holding command or management positions, and the military has no further use for their service, they are entitled to a one-time allowance in addition to the pension as prescribed by the Government of Vietnam;- Use of military uniforms, insignia, ranks, and badges on ceremonial days and during military traditional meetings;- Registration of household residency by local authorities where the officer legally resides, and facilitation for livelihood; if there is no private housing, housing or homestead land is provided as prescribed by the Government of Vietnam;- Medical examination and treatment in accordance with health insurance benefits at military and civilian medical facilities.
- Officers transitioning to another sector are entitled to the following benefits:
- The State ensures professional and vocational training needed for officers transitioning to another sector as required by the organization;- Maintenance of the officer's salary at the time of transition for a minimum period of 18 months;- Upon retirement, they are entitled to seniority allowances calculated based on the active service period and the military rank at the time of transition; if the current salary is lower than the salary at the time of transition, the salary at the time of transition is used to calculate the pension;- Use of military uniforms, insignia, ranks, and badges on ceremonial days and during military traditional meetings;- If recalled to serve in the military due to need, the transition period is counted as continuous service time for considering rank promotion and seniority.
- Officers demobilized are entitled to the following benefits:
- Employment assistance allowance and one-time demobilization allowance;- If serving in the military for 15 years or more, they are entitled to free or reduced fee medical examination and treatment at military medical facilities as regulated by the Minister of National Defense;- Use of military uniforms, insignia, ranks, and badges on ceremonial days and during military traditional meetings;- Registration of household residency by local authorities where the officer legally resides, and facilitation for livelihood; if there is no private housing, housing or homestead land is provided as prescribed by the Government of Vietnam.
- Officers retired due to disabilities are entitled to the following benefits:
- Benefits as prescribed by law for individuals with meritorious service to the revolution and social insurance benefits as regulated by the Law on Social Insurance;- Use of military uniforms, insignia, ranks, and badges on ceremonial days and during military traditional meetings;- Registration of household residency by local authorities where the officer legally resides, and facilitation for livelihood; if there is no private housing, housing or homestead land is provided as prescribed by the Government of Vietnam.
- Officers with periods of direct combat, combat support, or work in challenging areas or in occupations with special characteristics are entitled to convert that time to calculate benefits when ceasing active service.
- If an officer in active service is killed, their relatives are entitled to benefits as prescribed by law for individuals with meritorious service to the revolution and a one-time allowance as prescribed by the Government of Vietnam.
- If an officer in active service passes away, their relatives are entitled to benefits as prescribed by the Law on Social Insurance and a one-time allowance as prescribed by the Government of Vietnam.
