Basis for Determining the Fee for Appraising Economic-Technical Reports

Mr. Nguyen Tan (Quang Ngai) inquires: In the case where the investor has reviewed the construction drawing design and cost estimates before appraising the economic-technical report, should the State authority collect the fee at the prescribed rate or only collect 50% of the corresponding fee as stipulated in Clause 4, Article 4 of Circular 209/2016/TT-BTC?

On this matter, the Ministry of Finance has the following opinions:

At Point d, Clause 2 and Clause 4, Article 4 of Circular 209/2016/TT-BTC dated November 10, 2016 of the Ministry of Finance, which stipulates the levels of collection, policies of collection, payment, management, and usage of appraisal fees for construction investment projects and basic design appraisal fees, states:

“d) The appraisal fee for construction investment projects for small-scale works (appraisal of economic - technical reports) using State budget funds is determined according to the guidance at Point a of this clause.”

“4. For investment projects required to be appraised by a competent State agency, but the State agency does not have the conditions to appraise and has to hire experts, consultants for appraisal services, or there is a need for experts, consultants to appraise, or there has already been an appraisal before the State agency conducts the appraisal, the State agency is only allowed to collect 50% of the corresponding appraisal fee stipulated at Points 1 and 2 of the Fee Schedule issued with this Circular. The cost of hiring experts and consultants for appraisal is implemented according to the regulations of the Ministry of Construction.”

Based on the above regulations, if the investor has already conducted an appraisal before the State agency’s appraisal, the State agency is only allowed to charge 50% of the corresponding appraisal fee as stipulated at Points 1 and 2 of the Fee Schedule issued with this Circular (as stipulated at Clause 4, Article 4 of Circular 209/2016/TT-BTC of the Ministry of Finance).
