This content is stipulated in Circular 05/2013/TT-BLDTBXH issued by the Ministry of Labor, War Invalids, and Social Affairs providing guidance on the procedures for dossier preparation, dossier management, and implementation of preferential policies for people with meritorious services to the revolution and their relatives.
According to Article 42 of Circular 05/2013/TT-BLDTBXH, as stipulated, persons with meritorious services or their relatives who are receiving the benefits and allowances, if unable to receive the benefits and allowances directly, must establish a power of attorney with verification from the People's Committee of the commune where they reside.

In cases where the person with meritorious services is residing abroad, the power of attorney must be verified by a diplomatic representative agency or a consular agency of Vietnam in the foreign country.
The power of attorney is valid for 3 months for persons with meritorious services or relatives currently residing domestically and for 6 months for those residing abroad.
Note that when the authorization period expires, if no new power of attorney is provided within no more than 3 months, the Department of Labor, War Invalids, and Social Affairs will issue a decision to temporarily suspend the benefit policies.
Additionally, Circular 05 also stipulates procedures for handling cases of falsification or forgery of documents to receive preferential policies for people with meritorious services to the revolution. Specifically:
- Individuals who falsify or forge documents to receive policies or additional preferential policies for people with meritorious services to the revolution will be handled under the provisions of Article 43 of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution.- When signs of falsification or forgery are detected, the Department of Labor, War Invalids, and Social Affairs will issue a decision to temporarily suspend preferential policies and proceed with verification and conclusion or issue a document requesting the agency or unit that established the meritorious person’s dossier to verify and conclude.- If it is concluded that the individual forged or falsified documents, the Department of Labor, War Invalids, and Social Affairs will issue a decision to suspend the policies, recall wrongly received benefits, and request the agency or unit that established the dossier to revoke the issued documents and transfer them to the relevant agencies for handling in accordance with existing laws.
