Are Communist Party Members Subject to Disciplinary Action for Having a Third Child?

Previously, the family planning policy had a directive prohibiting having a third child for officials and public employees. However, up to now, Decree 176/2013/ND-CP does not mention the content of "handling third child birth" anymore. For party members, are there any cases where having a third child is allowed? If not allowed and a third child is born, what are the consequences?

According to Regulation 181/2013/QD-TW in 2013 on the disciplinary handling of Communist Party members for violations issued by the Central Executive Committee, "Communist Party members who violate any of the following cases that cause less serious consequences or violations in the case of giving birth to a third child (except for cases otherwise stipulated by law) shall be disciplined in the form of a reprimand."

Thus, Communist Party members who give birth to a third child (except for cases otherwise stipulated by law) will be disciplined in the form of a reprimand.

07 cases in which Communist Party members are allowed to have a third child:

The cases of giving birth to a third child without violating population and family planning policies as stipulated in Clause c, Point 10 of Guidance 09-HD/UBKTTW in 2013 are as follows:

- A couple gives birth to a third child if both or one of them belong to an ethnic group with a population below 10,000 people or belong to an ethnic group at risk of population decline (birth rate less than or equal to death rate) according to the official announcement of the Ministry of Planning and Investment.- A couple gives birth to triplets or more in their first childbirth.- A couple who already has one biological child gives birth to twins or more in their second childbirth.- A couple gives birth for the third time or more if at the time of birth, they only have one living biological child, including biological children given up for adoption.- A couple gives birth to a third child if they already have two biological children, but one or both of the children have disabilities or incurable diseases not of a hereditary nature, as certified by the provincial or central medical examination council.- Giving birth to a third child or more before January 19, 1989 (the effective date of Decision No. 162-HDBT, dated October 18, 1988 of the Council of Ministers "On certain population and family planning policies").

If falling into the aforementioned cases, Communist Party members giving birth to a third child will not be disciplined in the form of a reprimand.

The situation of Communist Party officials, especially those holding positions who violate population policies, significantly impacts the work of propaganda and mobilizing people to implement family planning. While giving birth to a third child is normal for some families, from the perspective of social management, there are many considerations. Multiple violations may lead to a risk of population explosion, gender imbalance, significantly affect the quality of life, lead to job shortages, give rise to social evils, and put pressure on the environment, transportation, and other public works.
