On June 29, 2024, the National Assembly promulgated the Law on Social Insurance 2024.

Application for survivorship allowance for relatives of participants in compulsory social insurance in Vietnam from July 01, 2025

Article 90 of the Law on Social Insurance 2024 stipulates the application for survivorship allowance for relatives of participants in compulsory social insurance:

* Application for survivorship allowance for relatives of those currently participating in social insurance or preserving the time of social insurance contributions includes:

- Social insurance book;

- Copy of the death certificate or death extract or copy of death notice or copy of the court's decision declaring the person dead;

- Declaration of the relative;

- Original or copy of the occupational accident investigation report in case of death due to an occupational accident; copy of the medical record of occupational disease treatment in case of death due to an occupational disease;

- Occupational disability assessment report from the Medical Assessment Council or a copy of the confirmation of particularly severe disability showing the conclusion of the Medical Assessment Council clearly stating the percentage of reduced working capacity for relatives with reduced working capacity of 81% or higher.

* Application for survivorship allowance for relatives of those receiving pensions or temporarily suspending the pension or monthly occupational accident, occupational disease allowances after retirement includes:

- Copy of the death certificate or death extract or copy of death notice or copy of the court's decision declaring the person dead;

- Declaration of the relative;

- Occupational disability assessment report from the Medical Assessment Council or a copy of the confirmation of particularly severe disability showing the conclusion of the Medical Assessment Council clearly stating the percentage of reduced working capacity for relatives with reduced working capacity of 81% or higher.

* Application dossier for funeral allowance in the case of just receiving a funeral allowance includes:

- Social insurance book, except for those receiving pensions or monthly allowances;

- Copy of the death certificate or death extract or copy of death notice or copy of the court's decision declaring the person dead;

- Declaration of the organization or individual handling the funeral.

Instructions on Handling survivorship allowance for Participants in Compulsory Social Insurance in Vietnam from July 01, 2025

Article 91 of the Law on Social Insurance 2024 stipulates the handling of survivorship allowance for participants in compulsory social insurance in Vietnam as follows:

- Within 90 days from the date a person preserving the time of social insurance contributions, a person receiving or temporarily suspending the pension, monthly occupational accident, and occupational disease allowance dies, the relative or the organization, individual handling the funeral shall submit the application dossier stipulated in Article 90 of the Law on Social Insurance 2024 to the social insurance agency.

- Within 90 days from the date a worker participating in compulsory social insurance dies, the relative or the organization, individual handling the funeral shall submit the application dossier stipulated in Article 90 of the Law on Social Insurance 2024 to the employer.

Within 30 days from the date of receiving a complete dossier from the relative of the worker, the employer is responsible for submitting the dossier to the social insurance agency.

- Within 10 working days from the date of receiving a complete dossier as stipulated, the social insurance agency is responsible for settlement; in cases of non-settlement, they must reply in writing and clearly state the reasons.

More details can be found in the Law on Social Insurance 2024 which comes into force in Vietnam from July 01, 2025.

The Law on Social Insurance 2014 and Resolution 93/2015/QH13 cease to be effective from the date the Law on Social Insurance 2024 comes into effect.
