From June 17, 2024, the application for remanufacturing codes under EVFTA and UKVFTA in Vietnam shall be made in accordance with the provisions of Decree 66/2024/ND-CP.

On June 17, 2024, the Government of Vietnam issued Decree 66/2024/ND-CP on management of importation of remanufactured goods according to Decree on management of importation of remanufactured goods under the EU-Vietnam Free Trade Agreement and the UK-Vietnam Free Trade Agreement.

Application for remanufacturing codes under EVFTA and UKVFTA in Vietnam

The refurbishment enterprise or trademark owner (hereinafter referred to as the requesting enterprise) shall submit 01 dossier of request for assigning Remanufacturing codes directly or via postal service or online (if applicable) to the Ministry of Industry and Trade.

The application for remanufacturing codes under EVFTA and UKVFTA in Vietnam includes:

- An application form for assigning Remanufacturing codes according to the template in Appendix VIII issued with Decree 66/2024/ND-CP (01 original).

- Business registration certificate of the requesting enterprise or other equivalent documents (01 copy with 01 Vietnamese translation if the language used in the copy is not Vietnamese, both authenticated by the requesting enterprise).

- Explanation of refurbishment capability, prepared for each refurbished item code registered for import into Vietnam (01 original in English and 01 Vietnamese translation, both signed by the signatory of the application for assigning Remanufacturing codes).

- Explanation that the refurbished goods meet the origin rules according to EVFTA and UKVFTA Agreements, prepared for each refurbished item code registered for import into Vietnam (01 original in English and 01 Vietnamese translation, both signed by the signatory of the application for assigning Remanufacturing codes).

- Commitment to provide warranty and maintenance policies for refurbished goods equivalent to those for the same type of unused goods, prepared for each refurbished item code registered for import into Vietnam (01 original in English and 01 Vietnamese translation, both signed by the signatory of the application for assigning Remanufacturing codes).

- Document from the trademark owner permitting the use of the original trademark on the refurbished goods or use on the goods for which they own the trademark in case the refurbished goods are details, components, and replacement parts (01 original in English and 01 Vietnamese translation, both signed by an authorized representative of the trademark owner).

- Document proving that the medical device refurbishing facility meets the Good Remanufactured Practice (GRP) guidelines or meets other regulations, standards, and guidelines for refurbishing facilities according to the law of the country where located: Only applicable to the refurbishment of medical devices.

Remanufacturing codes under EVFTA and UKVFTA

- The Remanufacturing codes is an identifier issued by the Ministry of Industry and Trade to the refurbishment enterprise or trademark owner organization.

- The Remanufacturing codes is issued to refurbishment enterprises or trademark owners who demonstrate refurbishment capability, warranty and maintenance policies, origin of goods, and trademark usage rights as prescribed in this Decree.

- The Remanufacturing codes is valid for a maximum period of 5 years from the date of issuance.
