Agency Handling the Case of Payment for Evidence Inspection Costs

On October 4, 2014, the Minister of National Defense decided to adopt Circular 131/2014/TT-BQP issuing the Regulation on the management of evidence warehouses in the Army.

Currently, the agencies adjudicating cases include agencies conducting legal proceedings, enforcement agencies, and units assigned to conduct certain investigative activities.

According to the provisions of Circular 131/2014/TT-BQP, regarding the management of evidence storage in the Military, the agencies adjudicating cases have the following responsibilities:

- The agency currently adjudicating the case is responsible for transporting, preserving, and protecting the evidence of the case until it is stored in the evidence warehouse or while it is being directly used to serve the investigation, prosecution, trial, and enforcement of the judgment.- In case the adjudicating agency cannot transport the evidence and has a written request, the Provincial Military Command cooperates with the Military Region Technical Agency to carry out the transportation.- Payment of costs for inspection, transportation, safe handling, or destruction of evidence as prescribed.

Additionally, the measures and procedures for handling arising cases in evidence management are also regulated by Circular 131 as follows:

- The Provincial Military Command presides over and coordinates with the adjudicating agency to organize inspections when it is detected that the evidence being kept, stored in the evidence warehouse is lost, damaged, deteriorated hazardous, reduced, or lost usability or evidentiary value or safety issues occur; agree on proposed procedures and measures to ensure safety or destroy evidence that does not ensure safety.- The order and procedures for handling unsafe evidence are carried out in accordance with the provisions of the law.
