The Ministry of National Defense has just issued Circular 85/2018/TT-BQP on June 23, 2018, detailing the adjustment of industrial explosive material usage permits.
To be specific, Circular 85 stipulates that in cases where the License for the use of industrial explosives expires, organizations or enterprises that need to continue using industrial explosives must prepare and send a dossier to the competent authority to request a reissuance of the License; the dossier must include a report on the results of the use of industrial explosives during the validity period of the previously issued License and the prescribed documents and materials.
In cases where the License for the use of industrial explosives is lost or damaged, organizations or enterprises must prepare a document following the prescribed Form and send it to the competent authority along with the required documents and materials as per legal regulations.
In cases where organizations or enterprises hold a valid License for the use of industrial explosives but need to change the name of the organization, enterprise, or the scale and conditions of using industrial explosives, they must prepare and submit a dossier to the competent authority to request an adjustment of the License; the dossier must include the appropriate documents and materials per legal regulations.
Within 05 working days from the date of receiving a complete dossier, the General Department of National Defense Industry will reissue, renew, or adjust the License for the use of industrial explosives for the organization or enterprise; if not, a written response must be provided, clearly stating the reasons.
Organizations or enterprises requesting reissuance, renewal, or adjustment of the License for the use of industrial explosives must pay a fee as regulated by the Ministry of Finance; this does not apply to units that are not enterprises engaged in defense and security project construction.
