6 Actions to take before site investigation in case of waterway traffic accidents in Vietnam

Recently, the Ministry of Public Security issued Circular 64/2020/TT-BCA, stipulating the procedures for investigation and handling of inland waterway traffic accidents by the Traffic Police force in Vietnam.

6 Actions to take before site investigation in case of waterway traffic accidents in Vietnam (Illustrative image)

Circular 64/2020/TT-BCA specifies 06 actions that Traffic Police must perform before investigating the scene when a domestic waterway traffic accident occurs in Vietnam. To be specific:

- Receive the tasks from the field protection unit;

- Identify the scope of the scene; the position of victims, traces, exhibits, and vehicles left at the scene. Utilize the camera equipment provided to Traffic Police to record the entire area of the scene before the investigation;

- Identify the investigation team members: Depending on the nature and extent of the traffic accident to invite appropriate investigation team members such as: forensic technical officers; fire prevention, firefighting, and rescue police; commune-level police where the traffic accident occurred; representatives of the inland waterway traffic vehicle registration unit or individuals, organizations with expertise (related to the inspection of inland waterway vehicles); representatives of the inland waterway management unit; representatives of technical units related to hydrological constructions such as river-crossing structures; witnesses, individuals with related rights and obligations; representatives of the local government where the traffic accident occurred; representatives of enterprises (individuals with expertise in valuation) to determine initial property damage value;

- Assign tasks to the participating investigation members;

- Select the investigation method; determine the suitable investigation direction; identify benchmarks onshore and underwater (reference points), which must be sustainable in terms of time, position, easily recognizable, and convenient for measuring, drawing site plans, and determining coordinates according to the national standard system to locate the accident site;

- Prepare the vehicles, equipment, and tools necessary for the scene investigation work.
