28 Prohibited acts in Vietnam under the Law on Road Traffic Order and Safety 2024

From January 1, 2025, there will be 28 prohibited acts in road traffic order and safety in Vietnam.

Law on Road Traffic Order and Safety 2024 was passed by the National Assembly of the Socialist Republic of Vietnam, 15th Session, at the 7th meeting on June 27, 2024.

28 Prohibited acts in Vietnam under the Law on Road Traffic Order and Safety 2024

To be specific: Article 9 of the Law on Road Traffic Order and Safety 2024 stipulates 28 prohibited acts as follows:

(1) Operating motor vehicles participating in road traffic without a driver's license as prescribed by law; operating specialized motorcycles participating in road traffic without a driver's license or a certificate of legal knowledge of road traffic, a license or certificate to operate specialized motorcycles.

(2) Operating vehicles participating in road traffic with alcohol concentration in the blood or breath.

(3) Operating vehicles participating in road traffic with drugs or other stimulants that are prohibited by law in the body.

(4) Insulting, threatening, hindering, resisting, or failing to comply with the orders, instructions, or inspection requirements of public officials ensuring road traffic order and safety.

(5) Racing, organizing races, inciting, aiding, or encouraging illegal racing; operating vehicles participating in road traffic with reckless driving, weaving, or continuous revving.

(6) Holding and using the phone or other electronic devices while operating vehicles participating in traffic on the roadway.

(7) Entrusting motor vehicles, specialized motorcycles to individuals who are not legally qualified to operate them in road traffic.

(8) Operating motor vehicles, specialized motorcycles that do not meet the safety and environmental protection standards required by law, other means that do not meet legal conditions for participating in road traffic.

(9) Importing, manufacturing, assembling motor vehicles, specialized motorcycles that do not meet the safety and environmental protection standards required by law.

(10) Illegally converting other vehicle types to passenger cars, except converting to passenger cars for defense and security purposes.

(11) Illegally altering or intentionally interfering with vehicle odometers; cutting, welding, erasing, chiseling, or illegally re-engraving vehicle frame numbers, engine numbers of motor vehicles, specialized motorcycles.

(12) Intentionally interfering with or altering registered vehicle control software to cheat inspection, testing results; renting or borrowing motor vehicle parts just to pass inspections.

(13) Transporting goods that exceed the vehicle's total weight, axle load, or dimensions limits; or exceeding the road limit without authorization or compliance with legal requirements; transporting goods that need binding but are not bound or improperly bound; exceeding the passenger count as prescribed by law.

(14) Transporting prohibited goods, illegally transporting or failing to comply with regulations on transporting hazardous goods and wild animals.

(15) Threatening, insulting, contesting, or luring passengers; coercing passengers to use unwanted services; transferring passengers or unloading to evade detection of overloading, or exceeding the legal passenger count.

(16) Installing or using sound and light equipment on motor vehicles, specialized motorcycles that disturb road traffic order and safety.

(17) Illegally producing, using, buying, or selling vehicle number plates; operating motor vehicles, specialized motorcycles with non-government-issued plates, improperly positioned plates; bending, covering plates; altering letters, numbers, colors, shapes, or sizes of plates.

(18) Interrupting or tampering with data from journey monitoring devices, cameras installed on vehicles as regulated by the Law on Road Traffic Order and Safety 2024.

(19) Destroying, damaging, or rendering ineffective road traffic control, monitoring devices, and intelligent traffic management equipment.

(20) Placing or leaving unauthorized obstacles on the road; scattering sharp objects, slippery substances on the roadway; spilling debris, goods, building materials, waste on the road; dumping hazardous chemicals and wastes causing road traffic safety threats.

(21) Obstructing individuals and vehicles from participating in road traffic; throwing bricks, soil, stones, sand, or other objects at people or vehicles on the roadway.

(22) Exploiting, abusing duties for road traffic order and safety to commit illegal acts, harassment, infringing on state interests, and legal rights of organizations and individuals.

(23) Using one's position, authority, or profession, or those of others, to violate road traffic order and safety laws, or interfering in the violation handling process.

(24) Using priority vehicle rights when not on duty as prescribed by law; installing or using unauthorized priority signal devices.

(25) Failing to report, falsely reporting, or providing incorrect information and documents to evade responsibility when detected violating road traffic order and safety laws.

(26) Fleeing after causing a road accident to evade responsibility; intentionally not aiding road traffic accident victims when able; infringing on the life, health, or property of accident victims, the offender, or those helping, rescuing, or transporting the injured for emergency care; exploiting traffic accidents to assault, threaten, incite, pressure, disturb, obstruct traffic accident resolution.

(27) Operating flying objects, unmanned aircraft, ultra-light aircraft within road boundaries causing obstruction or potential safety risks to road traffic participants, except authorized unmanned aircraft and ultra-light aircraft.

(28) Other acts violating road traffic rules as stipulated in Chapter II of the Law on Road Traffic Order and Safety 2024.

More details can be found in the Law on Road Traffic Order and Safety 2024, which comes into force in Vietnam from January 01, 2025.
