12 Legitimate Documents Required for Issuing a Construction Permit

To be granted a Construction Permit, organizations and individuals must provide the necessary documents in accordance with legal regulations.

To be specific, according to Article 3 of Decree 53/2017/ND-CP, 12 types of legal documents regarding land that serve as a basis for issuing Construction Permits include:

- Certificate of Land Use Rights (GCNQSDD) issued under the provisions of Land Law 1987, Land Law 1993, Amended Land Law 2001, Land Law 2003;- Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land, issued under the provisions of Land Law 2013, Amendment Law to Certain Laws Related to Basic Construction Investment No. 38/2009/QH12;- Certificate of Residential Land Use Rights and House Ownership issued under the provisions of Decree 60/CP, Decree 61/CP;- Certificate of Housing Ownership; Construction Works Ownership Certificate issued under the provisions of Ordinance on Housing 1991; Housing Law 2005; Decree 81/2001/ND-CP; Decree 95/2005/ND-CP; Decree 90/2006/ND-CP; Decree 51/2009/ND-CP; Article 31, Article 32 of Decree 43/2014/ND-CP;- Types of documents eligible for issuance of Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land but yet to be issued;- Land documents in cases where the Government allocates land, leases land or changes land use purposes from after January 01, 2004, but there is no Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land as per land law regulations;- Reports on land use status audits for cases where organizations or religious establishments are using the land without a Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land, checked and processed by the Provincial People's Committee where the land is located;- Documents classifying historical-cultural relics and scenic spots for cases where a construction permit is issued to construct, repair, renovate or relocate historical-cultural relics, scenic spots, but there is no Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land;- Certificate of Land Use Rights or location approval documents from the District People's Committee for billboard construction, telecommunications stations, antenna towers in areas not designated for construction purposes and not allowed for land use change;- Land lease contracts signed between the infrastructure work's investor and the manager or user of transport infrastructure work or written approval from competent state agencies regarding transport for construction projects allowed within land areas reserved for transportation as per legal regulations;- Written approval from competent state agencies allowing changes in land use purposes for cases where land users have legal land documents but request construction permits for uses different from the purposes stated in those documents;- Documents from competent state agencies that issued the Certificate of Land Use Rights, upon request from the construction permit issuing agency to determine land area for cases where land users have legal land documents, but the documents do not clearly state land area to serve as the basis for issuing construction permits.
