This is the content currently being solicited for comments on the Second Draft of the Residence Law 2020. The draft has proposed 05 locations where permanent and temporary residence registration is not allowed.
05 Locations Where Permanent and Temporary Residence Registration is Not Permitted (Illustrative Photo)
To be specific: Article 24 of the Draft Residence Law 2020 stipulates that permanent and temporary residence registration is not allowed when citizens move to a new place of residence that falls into one of the following cases:
- The place of residence is located within prohibited areas, in areas where construction is forbidden, or encroaches on the protection landmarks of technical infrastructure works, ranked historical or cultural monuments;- The place of residence where the entire housing area is situated on illegally encroached land, or the place of residence where the land area does not meet the construction conditions as stipulated;- The place of residence has a compensation plan, support, and resettlement by a competent state authority; the place of residence is housing where a part or the entire housing area is subject to disputes or complaints about ownership or usage rights that have not been resolved according to the law (except for cases where people with relationships such as grandparents, parents, spouses, and children move to live together);- The place of residence is subject to foreclosure, confiscation for sentence execution, or requisition according to a decision by a competent state authority;- The place of residence is a house that has a demolition decision by a competent state authority.
Thus, cases in prohibited construction areas, encroached areas, illegally built houses, places of residence with a resettlement plan, foreclosed places of residence, places of residence with a demolition decision will not be permitted for permanent or temporary residence registration.
