On December 31, 2024, the Minister of National Defense of Vietnam issued Circular 122/2024/TT-BQP on regulations for the implementation of democracy at the grassroots level in the Vietnam People's Army.

The principles for the organization and operation of the Military Council in Vietnam are specifically stipulated in Article 26 of Circular 122/2024/TT-BQP and include:

- The Military Council is organized according to the principle of democratic centralism, elected by the military congress through secret ballot; the content, program of activities, and decisions of the Military Council are democratically discussed and decided by majority vote. The Military Council assigns its members to take charge of different aspects of the work.

- The organization and operation of the Military Council are under the leadership of the party committee at the same level; under the direction, guidance, and inspection of the higher-level party committee, command, and political agencies at all levels.

- For newly established agencies or units temporarily formed for more than 12 months, the party committee will appoint a Military Council to organize activities; within 3 months, the military congress must be held to elect a new Military Council. Units operating for less than 12 months will have a temporary Military Council appointed by the party committee, which will dissolve after completing its mission.

Composition, standards, and number of Military Council members in Vietnam from February 15, 2025

Based on Article 28 of Circular 122/2024/TT-BQP, the composition, standards, and number of Military Council members are defined as follows:

- Composition of the Military Council: Soldiers, workers, and public defense employees in agencies or units with sufficient standards can self-nominate as members of the Military Council.

- Standards for Military Council members:

+ Possess firm political bravery, good moral character, a high sense of responsibility, strong fighting spirit, and capability to organize and implement assigned tasks, with an in-depth and practical manner, trusted by soldiers;

+ The President and Vice President of the Military Council must thoroughly understand the activities of the agency or unit, the duties, powers, and methods of the Military Council, and have the capacity to organize democratic activities within the agency or unit.

- Number of Military Council members:

+ Agencies or units with up to 60 people elect between 03 and 05 members; more than 60 people, elect no more than 09 members;

+ The President and Vice President of the Military Council are elected by the military congress from among the members through secret ballot. The President of the Military Council is not to be the head of the unit or secretary of the party committee.

- Addition and removal of Military Council members:

+ The addition of Military Council members is proposed by the Military Council and decided by the party committee; in special cases, the party committee appoints members;

+ If a Military Council member violates the law; violates the Army's discipline, has low prestige, the Military Council proposes the party committee to dismiss and select a replacement or organize a collective meeting of soldiers to elect additional members.

Circular 165/2018/TT-BQP of the Minister of National Defense stipulates the organization and operation of the Military Council in the Vietnam People's Army; Circular 46/2015/TT-BQP of the Minister of National Defense regulates the construction and implementation of democratic regulations at the workplace in Military enterprises will cease to be valid from the effective date of Circular 122/2024/TT-BQP.
