Subsection 5, Section 11 of Joint Circular 63/2016/TTLT-BTC-BGTVT on the inspection and supervision of unclaimed, abandoned, or lost baggage and cargo, stipulates the following:

The Director of the Civil Aviation Authority, the Director of the Airport, and the Head of the Customs Sub-department shall jointly organize the implementation of the following regulations:

a) Unclaimed, abandoned, or lost baggage must be checked together through X-ray inspection before being placed in a storage area for processing in accordance with the law. The customs authority shall lead and coordinate with the Civil Aviation Authority and airport security to conduct X-ray inspection.

b) If, during the X-ray inspection, goods or baggage with signs of violating the law are found, they must be inspected directly. Customs officials and airport security personnel shall prepare a list of goods or baggage with signs of violation, clearly stating the markings, number of packages, name of the baggage owner, flight number, and sign and seal the customs on the suspicious goods or baggage. These goods or baggage shall be handed over to the airport service business unit for management to invite the owner of the goods or baggage to open and inspect them in accordance with the law.

c) The actual inspection of goods or baggage in the absence of the owner of the goods or baggage shall be carried out in accordance with the regulations of customs law and airport security.

What are regulations on supervision of vehicles, drivers, and service personnel operating in restricted areas at airports in Vietnam?

Subsection 6, Section 11 of Joint Circular 63/2016/TTLT-BTC-BGTVT on the supervision of vehicles, drivers, and service personnel operating in restricted areas at airports, stipulates the following:

The Director of the Airport and the Head of the Customs Sub-department shall jointly organize the implementation of the following regulations:

a) The Airport shall provide the Customs Sub-department with a list of vehicles, drivers, and service personnel operating in the restricted area. The list shall include the following information: The number of vehicles, their type, license plate, scope of operation, and operating hours; The names of drivers and service personnel operating on the vehicles; The names of employees working and serving in the restricted area. The Airport shall promptly notify the Customs Sub-department of any violations of customs law or aviation law found during the inspection and supervision of the vehicles, drivers, and service personnel operating in the restricted area.

b) The Customs Sub-department and the Airport shall agree on the methods of inspection and supervision.

The specific form and content of information to be provided and shared between the customs authority and the airport will be discussed and agreed upon in a memorandum of understanding or coordination regulation.

What are regulations on supervision of goods entering and leaving, and businesses operating in restricted customs areas at airports in Vietnam?

Subsection 7, Section 11 of Joint Circular 63/2016/TTLT-BTC-BGTVT on the supervision of goods entering and leaving, and businesses operating in restricted areas, quarantine areas, cargo areas, aircraft repair and maintenance workshops, gate areas, and the customs management area, stipulates the following:

a) The Director of the Civil Aviation Authority shall inform the Head of the Customs Sub-department of the list of businesses operating in the quarantine area, restricted area, cargo area, and workshop.

b) The Director of the Civil Aviation Authority and the Head of the Customs Sub-department shall jointly inspect, supervise, and monitor the goods entering and leaving the above-mentioned areas; monitor the businesses operating in the area; promptly report any changes such as new businesses, business expansion, or changes in the industry; and promptly report any violations of customs law or aviation law by businesses operating in the area.
