What are contents of inspection and supervision of aircrafts on exit, entry and transit at airports in Vietnam?
Pursuant to Clause 2 Article 11 of the Joint Circular 63/2016/TTLT-BTC-BGTVT stipulating contents of inspection and supervision of aircrafts on exit, entry and transit at airports in Vietnam as follows:
a) Strictly comply with the provisions of law, professional procedures of customs, aviation security and safety;
b) Promptly notify information related to the flight crew and staff on the flight stopping at the airport in violation of the law or in violation of aviation security and safety;
c) The handling of law-breaking acts shall be handled by the competent authorities in accordance with the law on handling of administrative violations; cases arising of crimes shall be handled according to the provisions of the criminal law;
d) Working rules for service staff (cleaners, mechanics, refueling, loading and unloading, drivers...) and security guard when the aircraft is parked at the airport;
dd) The professional process of supplying petrol, meals, utensils, luggage and goods to and from the aircraft when it is parked at the airport.
What are regulations on checking and supervising special cases of supervision at the airports in Vietnam?
Pursuant to Clause 3 Article 11 of the Joint Circular 63/2016/TTLT-BTC-BGTVT stipulating regulations on checking and supervising special cases of supervision at the airports in Vietnam as follows:
a) Special cases of supervision include: aircraft and passengers that are hiding, transporting luggage, goods and articles banned from export or import or restricted from export or import; goods subject to import suspension under a decision of a competent authority; aircraft and passengers traveling from areas with epidemic surveillance requirements, cases for reasons of aviation security, safety, community protection, national security and cases on special request other;
b) The Director of the Customs Sub-Department and the Director of the Airport Authority or the Director of the Airport, depending on the regulations on information security authority, functions, tasks and actual location, shall cooperate with each other and coordinate with other functional forces in the airport area to have a plan for inspection and supervision. Monitoring includes the following:
b.1) Plan to closely monitor the key apron area; key passenger routes; pick-up and drop-off areas of baggage or key cargo;
b.2) Coordinate the allocation of human resources, shifts, means and equipment to use when necessary;
b.3) Method of coordination in the application of professional measures to detect, prevent, investigate and handle violations;
b.4) In case there is any suspicion of negative internal phenomenon or obstruction, report it to superior leaders for timely guidance and direction.
What are regulations on checking the actual baggage and goods at the airports in Vietnam?
Pursuant to Clause 4 Article 11 of the Joint Circular 63/2016/TTLT-BTC-BGTVT stipulating regulations on checking the actual baggage and goods at the airports in Vietnam as follows:
a) Strictly comply with regulations on order, procedures and competence to handle aviation security and safety of the Law on Aviation and Decree No. 92/2015/ND-CP dated October 13, 2015 of the Government on aviation security and regulations on order, procedures and competence of customs authorities of the Law on Customs and Decree No. 08/2015/ND-CP dated January 21, 2015 of the Government; physical checks must be carried out in front of the cargo and baggage owners;
b) In case of detecting prohibited goods, tax evasion or related violations, which must be temporarily seized or confiscated according to law provisions, administrative violations shall be handled according to the provisions of Decree No. 127/ 2013/ND-CP on sanctioning of administrative violations and enforcement of administrative decisions in the field of customs, Decree No. 147/2013/ND-CP on sanctioning of administrative violations in the field of goods non-civil; if there are signs of crime, they will be handled according to criminal law.
