Can Foreign Nationals Married to Vietnamese Nationals Obtain Permanent Residency Cards?
According to Article 39 of the 2014 Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, provisions regarding cases eligible for permanent residence are as follows:
Foreigners who have made a significant contribution to the cause of building and protecting the Socialist Republic of Vietnam and have been awarded medals or honorary titles by the Vietnamese state.
Foreigners who are scientists or experts currently residing temporarily in Vietnam.
Foreigners who are sponsored by their father, mother, spouse, or child who is a Vietnamese citizen and currently residing permanently in Vietnam.
Stateless individuals who have been residing continuously in Vietnam since the year 2000 or earlier.
Thus, based on the above regulation, since you are married and your wife is a Vietnamese citizen who is currently residing in Vietnam, she can sponsor her husband to obtain a permanent residence card.
However, it is also necessary to meet the condition of having resided continuously in Vietnam for 3 years or more (Article 40 of this Law). Therefore, you should compare the regulation with your specific case.
In addition, according to Point a, Clause 2 of Article 5 of Circular 31/2015/TT-BCA, the time of temporary residence in Vietnam for foreigners applying for permanent residence will be determined based on the entry and exit verification stamps issued at the border gates with a total temporary residence period in Vietnam of 3 years or more within the 4 years immediately preceding the date of application for permanent residence.
