Who Has the Authority to Establish a Market Management Board?

According to the provisions in Article 15 of Decree 02/2003/ND-CP:

  1. The Provincial People's Committee:

b) Decides on the establishment and stipulates the functions, duties, powers, and organization of the Market Management Board for type 1 markets (invested or supported with state capital for construction) currently operating under the management of the Market Management Board.

  1. The District People's Committee:

a) Decides on the establishment and stipulates the functions, duties, powers, and organization of the Market Management Board for type 2 and type 3 markets (invested or supported with state capital for construction) currently operating under the management of the Market Management Board.

Where:

- Type 1 Markets:

These are markets with over 400 business points, constructed solidly and modernly according to planning;

Located in important economic trade centers of provinces, cities, or as the main markets of industries, regions, and organized to meet regularly;

They have a market area suitable for the scale of market activities and organize a full range of services at the market: vehicle parking, goods loading and unloading, goods storage, measurement services, quality control services for goods, food safety and hygiene, and other services.

- Type 2 Markets:

These are markets with 200 to 400 business points, solidly or semi-solidly constructed according to planning; located in the economic exchange centers of the area and organized to meet regularly or irregularly; having a market area suitable for the scale of market activities and organize minimum services at the market: vehicle parking, goods loading and unloading, goods storage, measurement services, public sanitation.

- Type 3 Markets:

These are markets with fewer than 200 business points or markets that have not been solidly or semi-solidly constructed.

Primarily serving the buying and selling needs of the people in communes, wards, and neighboring areas.
