Hello, I am currently working in a remote commune in province X, currently we are building new houses to support poor households, near-poor households in the area do not know. What is minimum usable area for such a house? Please advise.

What is minimum usable area for new housing after being supported for poor households in Vietnam?

Pursuant to Article 4 of Circular 01/2022/TT-BXD stipulating requirements for housing quality after being supported are as follows:

1. After being supported for new construction or repair, a house must have a minimum usable area of ​​30m2 , ensure "3 hard" (base - hard foundation, frame - hard wall, hard roof) and longevity house for 20 years or more.

2. The foundation - foundation, frame - wall, roof parts of the house must be made from materials of good quality, not made of temporary, perishable and flammable materials. Specifically:

a) “Hard foundation - foundation” is the foundation - foundation of a house made of materials that increase the hardness of the foundation such as: cement mortar - sand, concrete, reinforced concrete, brick/stone, brick, paving, wood;

b) "Frame - hard wall" includes frame, column, wall system. Depending on specific conditions, frames and columns are made from various materials: reinforced concrete, iron, steel, solid wood; walls built of brick/stone or made of sturdy wood;

c) “Hard roof” includes roof support system and roof. Depending on specific conditions, the roof support system can be made from various materials: reinforced concrete, iron, steel, and solid wood. Roof made of reinforced concrete, tiled. In case the roof is made of corrugated iron with imitation tiles, cold corrugated iron, insulated corrugated iron, corrugated iron and has a solid supporting structure (iron frame, wood, etc.), which is firmly linked to masonry walls, reinforced concrete columns, the roof corrugated iron in this case is considered a durable material;

Depending on the actual conditions, housing parts can be made of locally available materials of equivalent quality that meet the standards and technical regulations, ensuring the shelf life . The People's Committees of the provinces (or authorize the Department of Construction) to prescribe specific types of local materials (if any), report them to the Ministry of Construction for consideration and decision.

Thus, newly built houses to support poor and near-poor households in Vietnam must ensure a minimum usable area of ​​30m2, ensure the "3 hard" (foundation - hard foundation, frame - hard wall, hard roof) and age. The life of the house is 20 years or more.

What is order of priority for housing support for poor households in Vietnam? 

According to Article 5 of Circular 01/2022/TT-BXD, order of priority for housing support for poor households is as follows:

1. Prioritize support for objects in the following order:

a) Poor ethnic minority households;

b) Poor households whose members are people with meritorious services to the revolution;

c) Poor households, near-poor households with members subject to social protection;

d) Poor households, near-poor households with extremely difficult circumstances (elderly people, lonely people, disabled people);

dd ) Poor households, near-poor households in areas frequently affected by natural disasters;

e) The remaining poor and near-poor households.

2. For poor and near-poor households with the same priority level, the support is provided in the following order:

a) Poor households and near-poor households have damaged or dilapidated houses (made of fast-failing and low-quality materials) that are in danger of collapse or unsafe;

b) Poor households, near-poor households without housing (are poor households, near-poor households without their own houses, currently living with their parents but separated, living in other people's houses, renting houses - except for school in case of renting state-owned houses);

c) Poor households, near-poor households have a large number of people.

According to this Article, priority is given to the objects in the order specified above in Vietnam.

Who has authority to organize the formulation and approval of housing support schemes for poor and near-poor households in the locality in Vietnam? 

In Article 6 of Circular 01/2022/TT-BXD, sequence of building a housing support scheme is as follows:

1. At village level and equivalent (abbreviated as village level)

a) The civil servant assigned the task of poverty reduction at the commune level in coordination with the village head to organize a meeting to disseminate the contents of the policy on housing support for poor and near-poor households according to the provisions of Decision No. 90/ Decision-TTg dated January 18, 2022 of the Prime Minister approving the National Targeted Program for Sustainable Poverty Reduction in the 2021-2025 period and this Circular to households; make a list of poor and near-poor households that need assistance in building or repairing houses;

b) On the basis of the list of poor households and near-poor households that need assistance in building new or repairing houses, commenting and proposing a list of poor households and near-poor households receiving housing support (according to form in Appendix I to this Circular) sent to the commune-level People's Committee for consideration and review. The meeting included the Steering Committee for the review of poor and near-poor households at the commune level, civil servants assigned to work on poverty reduction at the commune level, the village head (chairing the meeting), the secretary of the village cell, Women Union, Farmers' Union, Veteran's Association, Ho Chi Minh Communist Youth Union and representatives of poor and near-poor households in the village; invite representatives of the Vietnam Fatherland Front at commune level to supervise;

c) Households included in the list of requests for support must be approved by more than 50% of the participants in the contract (in the form of a show of hands or secret ballot).

2. At commune level

a) The commune-level People's Committees shall publicly post up the list of poor households and near-poor households that are proposed to support the construction or repair of houses at cultural houses or village community houses and the headquarters of the People's Committee. commune-level people; announce via commune-level radio station (if any) within 03 days;

b) At the end of the time limit for public posting, the commune-level People's Committees shall review, appraise, summarize and send to the district-level People's Committees a list of poor households and near-poor households eligible for support for new construction or housing repair.

3. After 03 working days from the time of receiving the report of the People's Committee of the commune, the People's Committee of the district shall summarize and approve the list of reports to the People's Committee of the province. In case the list must be readjusted, it must be re-approved and immediately reported to the People's Committee of the province.

4. Provincial-level People's Committees shall organize the formulation and approval of projects on housing support for poor and near-poor households in the area (using the form in Appendix VII to this Circular); send the Project to the Ministry of Construction, the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Planning and Investment, and the Ministry of Finance to summarize and report to the Prime Minister.

5. In case complaints and denunciations arise during the approval process of the list of poor households and near-poor households eligible for housing support, complaints and denunciations and settlement of complaints and denunciations shall comply with regulations. of the Law on Complaints and the Law on Denunciations.

Thus, the Provincial People's Committee organizes the formulation and approval of the Project on housing support for poor and near-poor households in the locality in Vietnam.
