I operate a passenger transport service including shuttle buses, and in the process of moving once I was recorded by the traffic police because my badge expired. But my badge was just issued 8 years ago, so is traffic police made the record right? Thank you!
What is validity period of signage granted to shuttle bus in Vietnam?
Pursuant to Clause 2, Article 22 of Decree 10/2020/ND-CP stipulating the validity period of signage is as follows:
2. Validity period of signage
a) Signage granted to a commercial automobile or shuttle bus is valid for 07 years or for a period requested by the auto transport business (between 1-7 years) given that the automobile or bus has not exceeded its service life;
b) For the “XE TUYẾN CỐ ĐỊNH” (“FIXED-ROUTE AUTOMOBILE”) signage granted to automobiles running extra services, the signage is valid for 30 days for the automobiles running on Lunar New Year and for 10 days for those running at the time of the national high school graduation examination.
According to this Article, the shuttle bus signage is valid for 07 years in Vietnam, so it is possible for the traffic police to make a record because you drive the shuttle bus with the signage issued for 08 years.
What are penalties for operating shuttle buses with an unexpired signage in Vietnam?
Pursuant to Point b, Clause 7 and Points a, d, Clause 8, Article 23 of Decree No. 100/2019/ND-CP providing for penalties imposed upon operators of civil and commercial passenger automobiles, and similar automobiles violating road traffic regulations as follows:
7. A fine ranging from VND 5,000,000 to VND 7,000,000 shall be imposed for:
b) Operating an international passenger transport vehicle without a badge or an unexpired one or one issued by a competent authority.
8. Apart from incurring fines, the vehicle operator that commits the violations shall also incur the following additional penalties:
a) The violation(s) specified in Clause 2, Clause 4 (in case of exceeding from more than 50% to 100% of number of passengers permissible for transportation); Points c, d and e Clause 3; Points a, b, c ,d , dd, e, h, i, k, l, m, o and q Clause 5; Clause 6; Point b Clause 7 of this Article shall lead to suspension of driving license from 1 month to 3 months;
d) The violation(s) specified in Point e Clause 6, Point b Clause 7 of this Article shall lead to confiscation of expired badges or badges issued by other than competent authorities.
