Penalties for Not Wearing a Helmet and Not Carrying Identification

Section 5, Article 21 of Decree 46/2016/ND-CP stipulates: A fine from 800,000 VND to 1,200,000 VND shall be imposed on operators of motorcycles with an engine capacity below 175 cm3 and motorbike-like vehicles if they do not possess a Driver's License.
Section 7, Article 21 of Decree 46/2016/ND-CP also stipulates: A fine from 4,000,000 VND to 6,000,000 VND shall be imposed on operators of motorcycles with an engine capacity of 175 cm3 or more, cars, tractors, and car-like vehicles if they do not possess a Driver's License.
According to Article 7 of Decree 05/1999/ND-CP, citizens are permitted to use their Identification Card as personal identification and must carry it when traveling and making transactions; it must be presented when requested by an authorized person for inspection and control. The Identification Card number can be used for recording in some other types of citizen documents.
Failure to carry and present an Identification Card when required for inspection will result in a warning or a fine from 100,000 VND to 200,000 VND according to Point a, Section 1, Article 9 of Decree 167/2013/ND-CP.
Therefore, for the offense of not having a driver's license, the fine can range from 800,000 VND to 1,200,000 VND or 4,000,000 VND to 6,000,000 VND depending on engine capacity. For the offense of not presenting an identification card when required for inspection, a warning or a fine from 100,000 VND to 200,000 VND will be imposed.
