Is it permitted to store impounded items and vehicles outdoors?

Regarding the custody of exhibits and vehicles temporarily seized under new regulations. The editorial board requests clarification: According to these regulations, can seized exhibits and vehicles be kept outdoors? We look forward to your prompt response.

The temporary storage location for the retained evidence and means must meet the conditions stipulated in Clause 2, Article 1 of Decree 31/2020/ND-CP (effective from May 1, 2020) as follows:

- Must ensure safety, security, and order; have protective barriers, entry and exit regulations, environmental protection regulations, and fire prevention and fighting regulations;

- Must be dry and ventilated. In cases where the temporary storage location for evidence and means is outdoors, it must be equipped with a roof or have measures in place for rain and sun protection;

- Must have a lighting system; be equipped with fire prevention and fighting equipment and technical means appropriate for the management and preservation of each type of retained and confiscated evidence and means.

=> Thus, according to the aforementioned regulations, the retained evidence and means can still be stored outdoors but must be equipped with a roof or have measures for rain and sun protection.
