Failure to Prepare and Report Estimated Costs for Providing Public Utility Telecommunication Services: What are the Penalties?

Based on Clause 4, Article 26 of Decree 15/2020/ND-CP (effective April 15, 2020) stipulating violations of regulations on public telecommunications services as follows:

- Fines ranging from 100,000,000 VND to 140,000,000 VND for any of the following acts:

+ Failing to establish and report the estimated budget to support the provision of public telecommunications services to the Ministry of Information and Communications;

+ Dominant telecommunications enterprises, and telecommunications enterprises holding essential means fail to register to participate in the implementation of the tasks of the Program for the provision of public telecommunications services;

+ Failing to submit the financial contribution plan for the planning year to the Vietnam Public Telecommunications Service Fund and the Ministry of Information and Communications;

+ Failing to determine the amount to be paid for the year according to the regulations to the Vietnam Public Telecommunications Service Fund;

+ Failing to separately account for and monitor revenues from services subject to financial contributions to the Vietnam Public Telecommunications Service Fund;

+ Providing public telecommunications services to ineligible beneficiaries.

=> Therefore, your case will be subject to a fine ranging from 100,000,000 VND to 140,000,000 VND.
