Can the Vice Chairman of the Commune People's Committee Impose Administrative Penalties on Traffic Violations?
Based on Article 75 of Decree 100/2019/ND-CP, the regulations are as follows:
- The Chairman of the Commune People's Committee has the authority to:
a) Issue warnings;
b) Impose fines up to 4,000,000 VND for violations in the field of road traffic and up to 5,000,000 VND for violations in the field of railway traffic;
c) Confiscate materials and means used for administrative violations with a value not exceeding the fine stipulated in point b of this clause;
d) Apply remedial measures stipulated at points a, b, and c, clause 1, Article 4 of this Decree.
Thus, the authority to impose administrative penalties in the field of traffic still resides with the Chairman of the Commune People's Committee. Additionally, this document does not stipulate the authority to impose penalties for the Vice Chairman of the Commune People's Committee. Therefore, the Vice Chairman does not have this authority.
