Application of Administrative Sanctions for Administrative Violations by Foreign Individuals
In Clause 3, Article 2 of the Law on Handling Administrative Violations 2012, it is stipulated:
Administrative handling measures are measures applied to individuals who violate laws on security, order, and social safety, who are not considered to be committing a crime. These measures include education at the commune-level, placement in reform schools, placement in compulsory education institutions, and placement in compulsory rehabilitation centers.
According to regulations in Chapter I, Part Three on administrative handling measures, the following measures are specified:
- Education at the commune-level.
- Placement in reform schools.
- Placement in compulsory education institutions.
- Placement in compulsory rehabilitation centers.
And in Clause 2, Article 5 of the Law, it is stipulated:
Administrative handling measures do not apply to foreigners.
=> Thus, according to the above stipulations, the aforementioned administrative handling measures do not apply to foreigners.
