Based on Article 112 of the Labor Code 2019 regulating public holidays:
Article 112. Public Holidays and New Year Holiday
- Employees are entitled to leave with full pay on the following public holidays and New Year holidays:
a) Gregorian New Year: 1 day (January 1 of the Gregorian calendar);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30 of the Gregorian calendar);
d) International Labor Day: 1 day (May 1 of the Gregorian calendar);
dd) Vietnam National Day: 2 days (September 2 of the Gregorian calendar and 1 contiguous day before or after);
e) Hung Kings' Festival: 1 day (March 10 of the Lunar calendar).
- Foreign employees working in Vietnam, in addition to the holidays specified in Clause 1 of this Article, are entitled to one more traditional New Year holiday and one Vietnam National Day holiday of their country.
- Annually, based on actual conditions, the Prime Minister of the Government of Vietnam shall determine the specific holiday dates stipulated in Points b and đ, Clause 1 of this Article.
Based on Article 220 of the Labor Code 2019 regulating the enforcement date:
Article 220. Enforcement Date
1. This Code comes into effect from January 1, 2021.
The Labor Code No. 10/2012/QH13 shall cease to be effective from the date this Code comes into effect.
- From the date this Code comes into effect, labor contracts, collective labor agreements, and lawful agreements that have been concluded and whose content does not contradict or ensures that employees have better rights and circumstances than the provisions of this Code shall continue to be implemented unless the parties agree on amendments or supplements to conform to and apply the provisions of this Code.
- The labor regime for officials and public employees, members of the People's Army, the People's Public Security, social organizations, cooperative members, and employees without labor relations shall be regulated by other legal documents, but depending on the subject, a number of provisions of this Code may apply.

However, after the National Assembly passed the Labor Code 2019, which took effect on January 1, 2021, employees are entitled to 2 days off for the Vietnam National Day holiday, including September 2 of the Gregorian calendar and 1 contiguous day before or after.
Therefore, the Vietnam National Day holiday entitlement began on January 1, 2021.

Where will fireworks be displayed in Ho Chi Minh City for Vietnam National Day?
On August 21, 2024, the People's Committee of Ho Chi Minh City issued a plan to organize fireworks displays to celebrate the 79th anniversary of the Vietnam National Day of the Socialist Republic of Vietnam (September 2, 1945 – September 2, 2024).
There are 2 fireworks display locations in Ho Chi Minh City for Vietnam National Day on September 2:
- High-altitude fireworks at the Saigon River Tunnel entrance, Thu Thiem Ward, Thu Duc City.
- Low-altitude fireworks at Dam Sen Cultural Park, Ward 3, District 11.
Fireworks will last 15 minutes, from 9:00 PM to 9:15 PM on the night of September 2.
The Chairman of the People's Committee of Ho Chi Minh City requires functional agencies to ensure absolute safety during the transportation of fireworks and at the fireworks display locations, as well as at areas where people gather to watch; to organize the diversion of road and river traffic around the fireworks display areas; and to prohibit vehicles from stopping or parking within 1,000 meters of the fireworks display positions.
