Is studying abroad considered a tourist? I live in Hanoi, I'm preparing to study abroad in Russia. I wonder if according to Vietnam tourism laws, my case can be called a tourist?

Pursuant to Clause 2, Article 3 of the 2017 Law on Tourism stipulates as follows:

2. “tourist” is a person who travels for either tourism or for other purposes combined with tourism, except for those travel to study or work.

So, your case is studying abroad in Russia, so you are not called a tourist according to regulations in Vietnam.

When applying to re-issue a tour guide card, do I need a health certificate in Vietnam? If I apply to reissue my tour guide card, do I need to submit an additional health certificate? My card was lost so I had to do it again.

According to Clause 1 and Clause 2, Article 63 of the 2017 Law on Tourism, regulations on re-issuance of tour guide cards are as follows:

1. The tour guide card shall be reissued in case of loss, damage or revised information. The expiry of the reissued tour guide card is the same as that of the old card.

Based on the above regulations in Vietnam, when you lose your tour guide card, you can apply for a new one.

2. An application for reissuance of the tour guide card includes:

a) An application form for reissuance of the tour guide card according to the form specified by the Minister of Culture, Sports and Tourism;

b) 02 3cm x 4cm color pictures;

c) Certified true copy of documents related to the revised information in case the card is reissued because information on the tour guide card is revised.

Thus, the application for re-issuance of a tour guide card does not require a health certificate, you only need to prepare the documents mentioned above in Vietnam.

What TOEFL score is required to qualify for an international tour guide card in Vietnam?

Let me ask, what TOEFL score is required to qualify for an international tour guide card in Vietnam?

Clause 2, Article 59 of the 2017 Law on Tourism regulates conditions for issuance of the tour guide card including:

2. To obtain the international tour guide card, a person shall:

a) satisfy the conditions prescribed in Points a, b and c, Clause 1 of this Article;

b) hold a college degree or higher in tour guiding; in case of a college degree or higher in another major, a certificate of training in domestic tour guiding is required;

c) have a good command of the foreign language registered.

Regarding regulations on proficient use of foreign languages, Article 13 of Circular 06/2017/TT-BVHTTDL amended by Clause 10, Article 1 of Circular 13/2019/TT-BVHTTDL has the following instructions:

1. The person who has a good command of a foreign language as prescribed in Point c, Clause 2, Article 59 of the Law on Tourism shall satisfy one of the following standards:

a) He/she holds an associate degree or higher in a foreign language;

b) He/she has completed an associate degree or higher training program designed in a foreign language;

c) He/she graduates college-level or higher in another country under a training program in the official language of the home country. In case of training by a language other than the official language of the home country, attach documents proving the language he/she is trained in;

d) He/she holds a certficate of foreign language proficiency at at least level 4 of Vietnam’s language proficiency framework or a valid certificate satisfactory to regulations set forth under Annex I of this Circular issued by a competent organization or agency.

2. The degree or certificate awarded by a foreign training institution shall be acknowledged as prescribed by the Ministry of Education and Training or Ministry of Labor, War Invalids and Social Affairs;

According to Appendix I of this Circular, TOEFL Certificate must achieve iBT 61 points.

Thus, a TOEFL certificate with iBT 61 points or higher is eligible to be granted an international tour guide card in Vietnam (for foreign language registered to practice is English).
