Article 17. Use of Fireworks
- Agencies, organizations, and individuals with full civil capacity may use fireworks in the following circumstances: festivals, Lunar New Year, birthdays, weddings, conferences, openings, anniversaries, and in cultural and artistic activities.
- When using fireworks, agencies, organizations, and individuals may only purchase fireworks from licensed manufacturing and trading enterprises.
According to the above regulation, agencies, organizations, and individuals with full civil capacity can use fireworks in the following circumstances:
- Festivals, Lunar New Year.
- Birthdays
- Weddings
- Conferences
- Openings
- Anniversaries and in cultural and artistic activities.
Thus, the Lunar New Year in 2025 is a major holiday in the year, so there will be fireworks in central-affiliated cities in our country.
What are the penalties for illegal use of fireworks in Vietnam?
According to Clause 3 Clause 7 Article 11 of Decree 144/2021/ND-CP governing violations related to the management of the use of weapons, explosives, explosive precursors, support tools, fireworks, and prohibited dangerous toys:
Article 11. Violations related to management and use of weapons, explosives, explosive precursors, support tools, fireworks, and prohibited dangerous toys

- A monetary fine from 5,000,000 VND to 10,000,000 VND shall be imposed for one of the following acts:
a) Exchanging, giving, donating, sending, borrowing, lending, leasing, or pawning weapons, support tools, explosive fireworks, imported fireworks, or fireworks materials for illegal fireworks production; components, assemblies of weapons, support tools, or scrap weapons, explosives, support tools;
b) Transporting or destroying weapons, explosives, explosive precursors, or support tools not ensuring safety or affecting the environment without being criminally prosecuted;
c) Failing to test, verify, assess, and register as per legal regulations on product quality management before being permitted to produce, trade, use weapons, or support tools in Vietnam;
d) Illegally storing or transporting scrap or defective weapons, support tools;
dd) Illegally transporting or storing prohibited dangerous toys;
e) Selling explosive precursors to organizations or enterprises that have not been granted a Certificate of Eligibility for security order, a Certificate of Eligibility for industrial explosives production, a license for trading explosive precursors, or without a written approval from the competent state authority;
g) Losing simple weapons, support tools, which were equipped;
h) Using weapons or support tools without a license;
i) Illegal use of various types of fireworks and fireworks materials;
k) Manufacturing, equipping, storing, transporting, or repairing weapons, support tools with a license but not conforming to legal provisions.

- Additional penalties:
a) Confiscation of violating materials, tools for administrative violations specified at Points d and đ of Clause 1; Points a, b, c, e, and g of Clause 2; Points a, c, d, đ, e, h, i, and k of Clause 3; Points a, b, c, d, đ, e, h, and i of Clause 4 and Clause 5 of this Article;

- The fine levels in Chapter II of this Decree are applicable to violations committed by individuals. For organizations with the same violations, the fine level is double that of individuals.

- A fine from 10,000,000 VND to 20,000,000 VND for organizations.
Additionally, organizations and individuals will have their violating materials, tools confiscated.
