When do employees in Vietnam return to work after the Lunar New Year 2025?
On November 26, 2024, the Office of the Government of Vietnam issued Official Dispatch 8726/VPCP-KGVX 2024 regarding the Lunar New Year holidays and other holidays in 2025.
For the 2025 Lunar New Year, employees will have the following time off:
[1] For officials and public employees: the 2025 Lunar New Year holiday is from January 25, 2025 (26th day of the twelfth lunar month of the Year of the Dragon) to the end of February 02, 2025 (5th day of the first lunar month of the Year of the Snake), totaling 9 days.
[2] For employees: Employees are entitled to a 5-day 2025 Lunar New Year holiday according to the Labor Code 2019.
However, in 2025, the 5 official days off are preceded by a weekend, Saturday and Sunday, January 25-26, 2025 (26th and 27th day of the twelfth lunar month). Following the official days off, there are again two weekend days, Saturday and Sunday, February 01-02, 2025.
Thus, employees will also have a continuous 9-day break for the 2025 Lunar New Year. From Saturday, January 25, 2025, to Sunday, February 02, 2025 (5th day of the first lunar month of the Year of the Snake).
Additionally, the Ministry of Labor, War Invalids, and Social Affairs encourages enterprises to allow employees to take time off according to the above 2025 Tet holiday schedule.
As such, employees return to work after the 2025 Lunar New Year on February 03, 2024, Gregorian calendar.
Do foreign workers in Vietnam get time off for the Lunar New Year?
According to Article 112 of the Labor Code 2019 on holiday:
Article 112. Holidays
- Employees are entitled to time off from work, with full pay, on the following holidays:
a) New Year's Day: 01 day (January 01, Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30, Gregorian calendar);
d) International Labor Day: 01 day (May 01, Gregorian calendar);
e) National Day: 02 days (September 02, Gregorian calendar, and 01 day immediately before or after);
f) Hung Kings Commemoration Day: 01 day (March 10, Lunar calendar).
- Foreign employees working in Vietnam, in addition to the days off prescribed in this Clause 1, are also entitled to 01 additional traditional New Year day and 01 National Day of their country.
- Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides the specific days off prescribed in Point b and Point e of Clause 1 of this Article.
According to the above regulations, foreign employees working in Vietnam are entitled to time off with full pay on the following holidays:
- New Year's Day: 01 day (January 01, Gregorian calendar)
- Lunar New Year: 05 days
- Victory Day: 01 day (April 30, Gregorian calendar)
- International Labor Day: 01 day (May 01, Gregorian calendar)
- National Day: 02 days (September 02, Gregorian calendar, and 01 day immediately before or after)
- Hung Kings Commemoration Day: 01 day (March 10, Lunar calendar)
- 01 day for their traditional New Year and 01 day for their National Day
Therefore, foreign workers in Vietnam are entitled to time off with full pay during the Lunar New Year.
