Is the Qingming Festival a national holiday in Vietnam? Are employees in Vietnam entitled to days off on the Qingming Festival in Vietnam?
According to Clause 5, Article 4 of Decree 145/2013/ND-CP, the national holidays are regulated as follows:
Major holidays
The major holidays in Vietnam include:
1. Lunar New Year Holidays (January 1st in the lunar calendar).
2. Founding Day of the Communist Party of Vietnam (February 3rd, 1930).
3. Hung Kings Commemoration Day (March 10th in the lunar calendar).
4. Victory Day (April 30th, 1975).
5. Victory Day at Dien Bien Phu (May 7th, 1954).
6. President Ho Chi Minh's Birthday (May 19th, 1890).
7. August Revolution Day (August 19th, 1945) and National Day of the Socialist Republic of Vietnam (September 2nd, 1945).
Pursuant to Article 112 of the Labor Code in 2019 stipulating public holidays:
Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
b) Lunar New Year Holidays: 05 days;
c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);
d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).
2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.
3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.
As regulations above, the Qingming Festival is not a national holiday in Vietnam. Therefore, the employees in Vietnam are not entitled to fully paid days off on this Festival. If the employees wiish to take leave during this Festival, they may take annual leave or unpaid leave after negotiating with the employers.
In case of taking annual leave, each employee has a number of days off as follows:
- 12 working days for employees who work in normal working conditions;
- 14 working days for employees that are minors, the disabled, employees who do laborious, toxic or dangerous works;
- 16 working days for employees who do highly laborious, toxic or dangerous works.
An employee who has been working for an employer for less than 12 months will have a number of paid leave days proportional to the number of working months.
